This Act is applicable to all professional, as well as parts of the private recruitment of foreign workers for employment abroad. It does not cover the recruitment of personal or domestic servants nor of nonmanual workers. Professional recruiters (except "worker-recruiters") must have a licence, which is granted on specified conditions. Offences against the Act are criminally sanctioned. The travel expenses for the recruited foreign worker (and his family) to the place of employment is the responsibility of the recruiter (but not the "worker-recruiter") or the employer. The recruiter or employer is responsible for the recruited worker during his journey and if he becomes incapacitated by sickness or accident during the journey, he (and his family) shall be repatriated at the recruiter's or employer's expense. Recruitment is conditioned on the age and the medical fitness of the recruited worker and the lack or coercion and misrepresentation during his recruitment. Recruited foreign workers must be above sixteen, but may, under certain conditions, be under eighteen. The medical fitness of the worker is to be established upon arrival. A medically unfit worker (and his family) shall be repatriated at the expense of the recruiter or the employer. The absence of coercion and misrepresentation in the recruitment procedure is to be established by a Judge upon the arrival of the recruited worker. On a contrary finding the recruited worker (and his family) shall be returned home at the expense of the recruiter or employer. If a worker not engaged, after being recruited, for a reason for which he is not responsible, the worker (and his family) must be repatriated at the expense of the recruiter or the employer.

A Center for the Stability of Home Helpers shall be established to provide services such as the collection of information and its dissemination to employers and home helpers, as well as the counselling and training of home helpers.

The Labour Law is amended as follows:
Section 1: The new law is referred to in the present Law by "The Law amending the Labour Law of 2008" and read in conjunction with the Law No. 8 of 1996, referred to by the original Law as amended. The Law enters into force as from the date of its publication in the Official Gazette.

Section 2: Section 2 of the original Law is amended in fine as follows: the following definition is added at the end of this section: "Tripartite commission": Tripartite commission for labour affairs is established under the provisions of section 43 of the present Law.

Section 3: section 3 of the original Law is repealed and replaced as follows:
a) Subject to the provisions of paragraph (b) of this section, the provisions of this law shall apply to all workers and employers, except for public servants and municipal employees.
b) Agricultural and domestic workers, cooks and gardeners, as well as assimilated persons are covered under by laws to be issued for this purpose. Such text shall regulate their contracts, rest hours, inspection and any other issues concerning their employment.

Section 4: Section 12(1)(c) of the original Law is amended by repealing the expression "those who are excluded from the scope of the Law according to section 3(c) and (d)" and to be replaced by the expression: " those to whom section 3(b) of the present Law is applicable".

Section 5: Section 29 of the original Law is amended as follows:
I.To add the expression "or all other forms of sexual assault punishable under the legislation in force".
II.The numbers of the paragraphs are reorganized from 1 to 7.
III.To add the expression as follows: b) If the Minister finds that an employer or his/her representative assaulted his/her employee or worker, by beating or exercising any sexual abuse against them, the minister may order to closure of the establishment for a period that deems appropriate, taking into account the provisions of any other legislation in force.

Section 6: Section 43 of the original Law is repealed and replaced as follows: A tripartite commission for labour affairs is established. It is chaired by the Minister, and its members are representatives form the Ministry and from employers and workers with equal numbers.

Section 7: Section 77 of the original Law is repealed and replaced as follows:
a)If the employer or the director of the establishment committed any offence of any section of this chapter or any provision of by-laws or order issued according to this chapter, he/she shall be punished by a fine not less than 300 dinars and not exceeding 500 dinars. The punishment should not be reduced below the minimum required by law.
b)In addition to the penalty provided by law, an employer shall be punished if he/she requests an a employee to work by force, fraud or threat, including confiscating his/her passport, by a fine of not less than 500 dinars, but less than 1,000 dinars.

Also deals with responsibilities concerning arrival and departure of the worker as well as repatriation. Finally provides fees to be paid to the Ministry as well as fees to be provided by the house owner to the recruitment agency.

An Order of the Minister of Internal Affairs to specify conditions of eligibility for a domestic service agency license and various other matter concerning the application of Legislative Decree No.40, 1992. Licensed agents are responsible for bringing domestic servants to Kuwait (usually from Asia) under a contract concluded with the prospective employer. The employer must pay the agency's commission and the servant's travel expenses, but if he is dissatisfied, the servant is repatriated at the agent's expense. Two model contracts are published at the end of the Order: the first is the contract of agency and the second, a contract of employment to be concluded between the employer and the servant. However, it is unclear whether these contracts are an integral part of the Order.

Provides that employment agencies supplying domestic servants must be licensed by the Ministry of Internal Affairs. Such agencies are now forbidden to charge job-seekers a fee for finding them employment. The Ministry is to set up a special inspectorate to supervise the operation of domestic service employment agencies. Any agent acting in breach of these provisions is liable to a maximum penalty of three months' imprisonment and a fine of 400 dinars. The Decree is published with an explanatory memorandum which states its purpose as being, inter alia, to prevent the exploitation of domestic servants.

These Rules regulate the conditions for emigration and recruitement of Pakistanis for work abroad. With some exceptions, all recruitment is subjected to a licensing requirement. The Rules detail the conditions for obtaining such a license. The emigration and recruitement procedure includes a review of all demands for labour by a "Protector of Emigrants" who may grant or refuse such demands. He is also in charge of the selection process, during which it must be established that the recruited workers have the required qualifications and that they fully understand the terms and conditions of service. The recruitment agent organizes the travel abroad of the recruited persons, but the cost is to be borne by the employer. The employer is also to bear the return travel expenses of the recruited worker upon expiration of his contract, unless the contract provides differently. Return travel expenses are however the responsibility of the recruitment agent if the recruited worker is not hired by the employer abroad because the worker is found unfit. The Government is entitled to fix minimum wage levels as well as other terms and conditions in contracts for employment abroad. The minimum age for employment of women as domestic workers is forty-five years. Exceptionally the minimum age limit may be lowered to forty years. Subject to a written decision to the contrary, the emigration of unaccompanied persons under eighteen is prohibited. The Welfare Fund, established by these Rules, is dedicated to the social and economic welfare of emigrants and their families. The Fund can be used for, inter alia, the establishment of vocational training institutions or other educational institutions, as well as the establishment and management of, or investment in commercial, industrial or service enterprises. The Rules institute a complaint procedure through the Labour Attaché abroad for emigrated workers in case of violations of the contract of employment by the employer. After having been selected, recruited workers must deposit a fixed fee which partially finances the Welfare Fund and partially represents the recruitment agent's fee.
