An Act to amend the Equal Opportunity for Women in the Workplace Act 1999, and for related purposes.

This Act requires various employers (relevant employers) to lodge reports each year containing information relating to various gender equality indicators (for example, equal remuneration between women and men).

Those reports are available to the public, subject to some exceptions for information that is personal information, information relating to remuneration and information of a kind specified by the Minister.

There is a Workplace Gender Equality Agency. Its functions include advising and assisting employers in promoting and improving gender equality in the workplace and undertaking research and programs for the purpose of promoting and improving gender equality in the workplace.

There is a Director of Workplace Gender Equality, who manages the Agency.

The Agency may review a relevant employer's compliance with this Act by seeking further information from the employer.

If a relevant employer fails to comply with this Act, the Agency may name the employer in a report given to the Minister or by electronic or other means (for example, on the Agency's website or in a newspaper).

An Act to establish the Social and Community Services Pay Equity Special Account, and for related purposes

This Act establishes the Social and Community Services Pay Equity Special Account.

Section 6 provides for annual credits of money to the Account for the 2012¿13 financial year through to the 2020¿21 financial year.

Section 7 provides that a purpose of the Account is to assist certain employers in the Social, Community and Disability Services Industry to meet the costs of payments required to be made as a result of certain pay equity orders. That section sets out the other purpose of the Account.

Section 8 provides that amounts may be debited from the Account and credited to the COAG Reform Fund for the purpose of making grants to the States or Territories in relation to the same kind of assistance.

This Act ceases to have effect on 30 June 2021.

Makes a number of significant changes to the Disability Discrimination Act, in particular: by inserting an explicit reference to the Disabilities Convention in s 12(8)(ba) of the DDA; the definition of disability in s 4 of the DDA has been changed to include a genetic predisposition to a disability; the principal definition of indirect disability discrimination has been amended in a number of respects (section 6); Section 6(1)(c) now requires an aggrieved person to prove that the condition or requirement "has or is likely to have the effect of disadvantaging persons with the disability"; the burden of proving that a requirement or condition is reasonable has now shifted to the respondent (s 6(4)); introduction of what is described as a "duty to make reasonable adjustments for a person with disability" (sections 5(2) and 6(2)); s 21A(1) of the DDA provides a defence to a claim of unlawful discrimination in work in certain circumstances.
Also amends the the Human Rights and Equal Opportunity Commission Act 1986 which is now to be called the Australian Human Rights Commission Act 1986 (AHRC Act).

Part I provides amendments to the Disability Discrimination Act 1992, Privacy Act 1988, Racial Discrimination Act 1975 and the Sex Discrimination Act 1984 relating to enforcement of determinations. The Human Rights and Equal Opportunity Commission or a complainant may commence proceedings in Federal Court for an order to enforce a determination. Furthermore, the Court may grant an interim junction pending the determination of the proceedings if it is satisfied that the respondant has engaged in unlawful conduct. Amendments also provide for assistance in proceedings before Federal Court in cases of hardship. Part II amends the Human Rights and Equal Opportunity Commission Act 1986 by, inter alia, providing a new outline of the functions and powers of the President of the Commission. Part III provides minor technical amendments to the Acts in Part I.

This Act establishes the Human Rights and Equal Opportunity Commission, consisting of a President, a Human Rights Commissioner, a Race Discrimination Commissioner and a Sex Discrimination Commissioner. Its functions include those conferred by the Race Discrimination Act 1975, the Sex Discrimination Act 1984 or any other enactment; examining enactments and proposed enactments; inquiring into any act or practice that may constitute discrimination or be inconsistent with or contrary to any human right; seeking settlements in such cases; promoting human rights and equal opportunity; and advising on matters related thereto (ss. 11 and 31). This Act sets forth the procedures applicable to handling written complaints of infringements of human rights (s. 20) and of discrimination in relation to equal opportunity (s. 32). In the Act, the term "human rights" means the rights and freedoms recognised in the International Convenant on Civil and Political Rights, rights declared by the United Nations Declarations on the rights of the child, mentally retarded persons and disabled persons, or those recognised or declared by any relevant international instrument (s. 3(1)). The word "discrimination" encompasses discrimination on the basis of race, coulour, sex, religion, political opinion, national extraction or social origin, as more fully defined in s. 3(1). The ILO Discrimination (Employment and Occupation) Convention, 1958 (No. 111) is containted in Schedule 1 of the Act, which empowers the Commission to report on the action, if any, that it believes needs to be taken in order to ensure compliance with that Convention (s. 31(f); see also s. 3(1) and (8)).

The Act requires designated employers (private employers with 100 or more employees in Australia, and institutions of higher education) to develop affirmative action programmes. These programmes shall be designed to ensure that appropriate measures and action are taken to eliminate discrimination against women and to promote equal opportunity for them. The contents of the programme shall include policy statements, designation of persons responsible for implementing the programme, consultation with trade unions and employees, collection and recording of statistics, examination of policies and practices tending to discriminate, establishment of quantitative objectives and estimates, and monitoring and evaluation. Employers are required to report on these matters. The Act sets up the post of Director of Affirmative Action, whose functions and powers are defined.

The objects of this Act are to eliminate discrimination against persons on the grounds of disability in areas of work, accomodation, education, access to premises, clubs and sport, and the provision of goods, facilities, services and land. The intention is also to prohibit discrimination under existing laws and the administration of Commonwealth laws and programmes, to ensure that persons with disabilities have the same rights to equality before the law as the rest of the community, and to promote the recognition and acceptance within the community of the principle that persons with disabilities have the same fundamental rights as the rest of the community. Part 2 concerns the prohibition of disability discrimination; Part 3 provides for "action plans" to eliminate such discrimination; Part 4 deals with inquiries and civil proceedings; Part 5 specifies additional offences under the Act; and Part 6 provides for the appointment of a disability discrimination commissioner.
