Privatization is defined as the sale of State property by its owner, the State, to private owners who may include Kazakh and foreign individuals and companies. In order to prevent renationalization of privatized State property, the decree prohibits companies in which the State owns more than 20 percent of the shares from participating in the process of privatization. Transparency and competition are the basic principles of the privatization process. The principal privatization methods include auction, tender and direct sale. Disputes arising from the privatization process are subject to the jurisdiction of the Kazakh courts.

Section 25 governs the enlistment of foreign workers. Social insurance and security are provided for in Section 26. Payments of foreign workers' pensions shall be credited to the respective funds of the countries of their permanent place of residence.

Sets out procedures regarding the State Privatization Fund of the Republic of Kazakhstan, licensing of activities of privatization investment funds and the governing of these funds, and suspending and revoking licences. The procedure is conducted by an interdepartmental commission formed by the Cabinet of Ministers of the Republic of Kazakhstan. Provides for obligations of the State Committee for State Property such as confirming the temporary instruction on the procedure for evaluating the pure assets of the privatization investments funds, including the procedure for determining the expenses, the compilation of the financial results of investment funds, and the estimation of privatization investment coupons. Provides that the Cabinet of Ministers and National Bank should have reserves of centralized credit resources to be made available to give financial aid to privatized investment funds.

Chapter III governs labour relations and employment conditions. Collective agreement shall not contradict national legislation. Workers shall be guaranteed a minimum wage as well as social security.

States that conditions of work and employment shall not be less favourable than in national enterprise. Labour relations shall be regulated by collective agreement and individual labour contracts. Labour disputes relating to hiring or dismissal shall be dealt with at the enterprise level.
