    An Act to provide for and regulate the transfer (privatisation) of prescribed State enterprises, banks, insurance companies and other organisations (see Sec.1(3) and Sec.4) to Czechoslovak or foreign legal or natural persons. Provisions are made for various administrative and financial aspects, including preparation and government approval of proposed privatisation projects, the establishment and operation of special Federal and Republic Funds to administer privatisation transactions outside the State budget, the issue of non-transferrable "investment coupons" entitling the bearer to purchase specific shares, and other matters connected therewith.

    Basic Act listing fundamental rights and freedoms in the form of a Constitutional Act adopted by the Federal Assembly of the Czech and Slovak Federal Republic. No. 23.

    An amended section of the Constitutional Act of 27 October 1968 (s.5) now provides that "any national of either Republic (ie. Czech or Slovak) shall ipso facto be a national of the Czech and Slovak Federal Republic". The new Act repeals ss.7 to 9 ("Socialist economic system") and Chapter II (ss.19 to 38: "Rights and duties of citizens") of the Constitutional Act of 11 July 1960 (LS, 1960-Cz.2). The schedule to the Act, entitled "List of fundamental rights and freedoms", is divided into six parts respectively entitled "Common provisions" (reminiscent of the introductory provisions of most democratic constitutions), "Personal rights and fundamental freedoms" (fundamental personal rights and freedoms, political rights). "Rights of national and ethnic minorities" (not specified), "Economic, social and cultural rights", "Right to justice and other rights to personal protection" and "General provisions" (specifying that some of the rights listed are to be reaffirmed by specific legislation).     Contains provisions about human rights and fundamental freedoms such as the inviolability of the person, the right to own property. Lays down a list of political rights including the right to vote and the right to information. Contains some provisions about the rights of national and ethnic minorities including the right to education in their language. Grants the right to associate freely with other for the protection of his or her economic and social interest, the right to strike. Employees are entitled to fair remuneration for work and to satisfactory working conditions. Provides the right to legal assistance in proceedings held before courts.

Detailed provisions are made for auctioning procedures (Secs.4-17) and requirements to be met by buyers.

    Under this Act, the Ministry of Labour and Social Affairs is entrusted with responsability for labour relations, employment, the civil service, wages and other forms of remuneration, health insurance, social protection for children and young persons and all matters related to social policy (s.5). The Slovak Labour Protection Office is responsible for ensuring occupational health and safety (s.25).

    Amends the Act of 28 December 1968 respecting the establishment of the Ministries, etc., as amended up to 1990 (Text No. 96). The Ministry of Finance, Prices and Wages is renamed "Ministry of Finance and Prices" and all matters pertaining to wages are transferred to the Ministry of Labour and Social Affairs. The Ministry of Health and Social Affairs is renamed "Ministry of Health" and all matters pertaining to social policy are transferred to the Ministry of Labour and Social Affairs.

    Notification of the Federal Ministry of Labour and Social Affairs respecting workers' remuneration in citizens' private undertakings. No. 135.

    This Notification applies to private undertakings under the Act of 23 April 1990 (Text No. 105) whose workforce does not, generally exceed 200 employees. Its provisions supplement those of the Ordinance of the same date respecting labour relations in such undertakings (Text No. 121). It sets out a scale of basic wages and provides for remuneration in respect of overtime, stoppage imputable to the undertaking, nightwork, home-work, hazardous work, work on weekends, etc. Employers are required to bring this Notification to the attention of their workers. Examples of occupations classified by wage step are given in a schedule.

    This Act cancels a significant number of judicial decisions made between 25 February 1948 and 1 January 1990 under various Acts, including the Act of 18 December 1969 respecting misdemeanours. The Act is divided into eight parts; the sixth, entitled "Compensation", covers unfair dismissal among other matters. (English translation available).

    Government Ordinance of the Czech and Slovak Federal Republic respecting Labour Relations in Citizens' Private Undertakings. (Text No. 121)

    Made under the Citizens' Private Undertakings Act, of 18 April 1990 (Text No. 105). Provides that in the absence of any stipulation to the contrary labour relations in private undertakings shall be governed by the Labour Code as amended to 14 December 1988.

    Economic Relations with Foreign Countries Act of 19 April 1990.

    This Act is intended to provide more scope for foreign economic activity and open up the Czechoslovak economy to the outside world by relaxing the rules on economic relations with foreign countries; allowing Czechoslovak natural persons to engage in foreign economic activity-in principle on the same terms as legal persons; reforming the system of registration and authorisation to carry on economic activities with foreign countries; and providing for security deposits, administrative formalities, individual membership of the Czechoslovak Chamber of Commerce and Industry and other matters. Authorisation granted under the previous Act on this subject is automatically recognised as authorisation or registration under the amended version. However, Czechoslovak organisations trading with CMEA countries under Section 7 (2) (b) of the previous Act must be registered or authorised to do so within three months of the entry into force of the new Act. Amends Act No. 42/1980 Coll., on Economic Relations with Foreign Countries in the version of Act No. 102/1988 Coll, and amends and repeals many other statutory provisions concerning foreign trade and related matters (section 63).     Enterprise with Foreign Property Participation Act of 19 April 1990.

    Amends the Enterprise with Foreign Property Participation Act, No. 173 of 1988. Under the new Act, foreigners may establish wholly-owned subsidiaries or purchase up to 100 per cent of an existing firm; investment may be made in stock corporations, limited liability companies, limited partnerships, general partnerships, and limited partnerships with shares; investment in "associations" (under an older act)is still permitted; and, for the first time, the Czechoslovak partner (if any) may be a natural person. The new Act also simplifies authorisation requirements, eliminates certain technical formalities and allows joint venture contracts to be governed by foreign law.

    This Act consists of four parts, respectively entitled "Preliminary provisions" ("social role" of enterprises, workforce collectives, labour relations in terms of ss.27 and 70 of the Labour Code (LS, 1975-Cz.2) as amended at 14 December 1988), "Common provisions" (establishment and winding up), "Enterprise bodies and rights and duties of the managing director" and "General, transitional and final provisions" (the Act of 14 June 1988 on the same subject is repealed).

    Makes detailed provisions for the establishment, operation, extinction and organisation of joint-stock companies, the obligations and rights of shareholders, changes in capital stock and related matters. Under the new Act, the establishment of joint stock companies is not subject to clearance or supervision by the State, and a provision for establishment by a single founder having legal personality and underwriting the entire stock enables the State to transform existing enterprises into joint stock companies. Act No. 243/1949 on Joint Stock Companies is repealed.

    This Act consists of five parts. Part I, entitled General Provisions, begins as follows: "Any citizen may carry on entrepreneurial activity in his personal capacity subject to the restrictions and conditions prescribed in this Act". No limit is imposed on the number of his employees or on the amount of his capital. The other parts are respectively entitled "Requirements to be met by entreprenuers" (registration of enterprises and other administrative provisions). "Legal relationships binding entrepreneurs" (in particular employment relationships; applicability of ss.187 to 205b-compensation for damage, enterprise liability- of the Labour Code (LS, 1975-Cz. 2) as amended on 14 December 1988), "Judicial supervision" and "Transitional and final provisions" (including repeal of certain provisions of the Decree of 24 October 1945 and of the Act of 28 April 1948 respecting the nationalisation of certain industrial undertakings).

    Section 1 defines conscientious objection. This is followed by four parts, respectively entitled "Organisation of civilian service", "Conscription, enrolment and enforcement" (citizens between the ages of 18 and 38 years are subject to conscription; protected rights, exemption, leave, obligations of a conscript subject to s.73 -basic obligations of workers- of the Labour Code (LS, 1975-Cz.2) as amended at 14 December 1988 and of the organisation employing him, which must inter alia provide him with a wage equivalent to that of a soldier; working time; regular and special leave; compensation for damage caused by either party), "Punishable acts committed by persons liable to civilian service" (insubordination, desertion) and "General and final provisions" (the duration of civilian service is counted towards length of service).

    The Notification reprints the Czechoslovakia translation of the Convention No. 155 adopted on June the 3rd, 1981 by the I.L.O.. The Convention was ratified by the Czechoslovakia Socialistic Republic on 1988-12-02 and the instrument of ratification was deposided with the I.L.O. Director General.

    This Act, which contains six Parts, has as its purpose to issue "provisions, legal measures and operational principles" for enterprises considered to constitute "basic elements of the national economy" having a social aim in the implementation of the state plan. According to Part I (Introductory provisions), this embraces all workers of the enterprise who are in an employment relationship within the meaning of ss. 27 et seq. of the Labour Code (LS 1975 - Cz. 2 (cons.)), excluding those in a subsidiary employment relationship (s. 70 of that Code). Save exceptions (for example, liquidation under s. 251 of that Code), the enterprise and the State have independent responsibilities; in case of a dispute, resort may be had to "economic arbitration" pursuant to the Economic Code of 1964 (Part II: Rules and operations of the enterprise). The other Parts of this Act deal respectively with the following: establishment, registration and dissolution of the enterprise; management organs of the enterprise and socialist self-management; "socio-economic functions" within the meaning of the Economic Code; social development of the workers' collective, and common, transitional and final provisions (Part VI, indicating 1 July 1988 as the date of entry into force).

    Notification of the Federal Ministry of Labour and Social Affairs issuing regulations regarding termination of employment, placement and income security for employees, in conjunction with the reorganisation of the national economy and its central bodies. Text No. 82.

    This text makes applicable, unless otherwise indicated, the Principles and Procedures of 11 Feb. 1988 (Text 31) and, with regard to the reorganisation of "central bodies", the Notification of 3 July 1970 (Text 74). At least three months' notice shall be given to an employee in case of termination of the employment relationship, and the employee shall be granted assistance in seeking new employment. If necessary, he or she shall receive the difference between his or her previous average earnings and the average earnings in the new job for the first three months of new employment, and 80 per cent of this difference over the following three months. The same shall apply in case of a change affecting the enterprise, as stipulated in s. 46(1)(a) to (c) of the Labour Code (LS 1975 - Cz. 2) and in case of restructuring or reduction in force. Acquired rights shall be fully maintained for purposes of ss. 249 to 251 of the Code.

    German translation of the Act, which sets requirements for setting up an enterprise in which foreigners participate financially. The Act defines the status of such enterprises and lays down conditions for approval of contracts establishing such undertakings. It also contains rules on financing, foreign exchange, currency transfer abroad and liquidation.
