El citado decreto aprueba la lista de trabajos que se encuentran prohibidos para los menores o que estos los pueden realizar observando determinadas condiciones. Establece que los menores de edad que asistan a cursos de formación práctica profesional podrán trabajar, siempre que el empleador solicite la autorización correspondiente a la Inspección General de Trabajo. Para ello, dicha entidad deberá constatar que en el lugar de trabajo respectivo existen las condiciones técnicas necesarias para prevenir el riesgo de accidentes de trabajo y enfermedades profesionales.

Article 3 provides some exceptions that may be made to the rule after consideration by the Ministry of Social Affairs, Labour, Vocational Training and Youth Rehabilitation.

El acuerdo citado actualiza el Reglamento para la aplicación del artículo 13 del Código del Trabajo, prohibiendo la participación de adolescentes en los trabajos que define como peligrosos por su naturaleza o sus condiciones. Asigna al Ministerio del Trabajo y Previsión Social la actualización cada dos años del listado de los trabajos o actividades peligrosos. Establece las condiciones de celebración de un contrato de trabajo con un adolecente y las obligaciones que habrá de cumplir el empleador en tal sentido. Excluye de su ámbito de aplicación a la prestación de servicios a que se refiere el inciso 3 del artículo 8 del Código del Trabajo. Atribuye a la Dirección del Trabajo la fiscalización del cumplimiento de las normas del Reglamento.

Impone a las autoridades competentes el deber de identificar y sancionar a los responsables del incumplimiento de las disposiciones sobre la prohibición del trabajo infantil peligroso.

The Act applies to the whole of the Province of the Khyber Pakhtunkhwa. It defines a child as anyone under the age of 14 and an adolescent as anyone between the ages of 14 and up until they have completed their 18th year of age. Prohibits the employment of children in any work except for light work for a maximum of two hours a day if this is part of their training or with family members. No adolescent is to be employed or permitted to work in any hazardous work included in the Schedule.

Repeals the Employment of Children Act, 1991 (Act No. V of 1991) to the extent of the Province of the Khyber Pakhtunkhwa.

It provides that social partners such as labor organizations, federations, employers’ organizations and other non-government organizations will be tapped to assist the DOLE in the dissemination and in monitoring the implementation of the Guidelines. Department Order No. 149, Series of 2016 supersedes Department Order No. 4, Series of 1999 (Hazardous Work and Activities to Persons Below 18 Years of Age). Department Order No. 149-A, Series of 2017 amended the Guidelines particularly work and activities under Farmers and Other Plant Growers and Animal Producers occupational classifications.

Pursuant to the Laws of Ukraine "On Occupational Safety" (2694-12) and the Decree No. 64 of 27 January, 1993 "On Measures to Implement the Law of Ukraine "On Occupational Protection"", approves the list of heavy works and works with harmful and dangerous working conditions, in which the use of the labour of persons under the age of 18 shall be prohibited. The use of the labour of minors in the works included in the attached list shall be prohibited in all enterprises, companies and organizations irrespective of the forms of ownership and the types of their activities. Also states that admission to study in the professions enlisted in the list is allowed provided that the persons reach the age of 18 years at the time of graduation. Also establishes, that after passing the production training, persons under the age of 18 years, studying in vocational schools, can be ungagged in works included in the list not longer than for 4 hours with a strict adherence to the current sanitary, as well as occupational safety norms and rules.

Enumera, sobre la base de diferentes consideraciones (rama de actividad, puesto de trabajo y tareas, agentes o riesgos, impactos en la salud, etc.) las tareas y procesos peligrosos a los que no deben estar expuestos los niños y niñas.

2. Specific objectives:
- To prevent the delinquency situation of children and support street children, with a view to reducing by 90% the number of those children by the year 2010, of whom 70% shall be rendered support to integrate themselves with their families.
- To prevent, gradually reduce and proceed to substantially reduce by the year 2010 the number of sexually abused children.
- To prevent and solve the situation that children have to do heavy jobs or work under noxious and hazardous conditions in order to reduce by 90% of the number of those children by the year 2010.
- To raise the managerial capability of officials engaged in child protection work, specially those of the ministries, branches and People¿s Committees of all levels in charge of protecting and caring for children in special circumstances.
