Under the Act, a cooperative is an association of persons who have voluntarily joined together to achieve a common social and economic end through the formation of a democratically managed and controlled organization. Provisions are made for the establishment of a department of cooperative developement which provides assistance, guidance and advice relating to the organization, management, coordination and integrated functionning of cooperatives. Conditions for registration include a membership of at least eleven individuals and the approval of the registrar , (whereas conditions for registration of a secondary cooperative include a membership of at least three cooperators It sets forth the criteria for membership (as well as its termination) and lists the shares it may hold. Other provisions cover the management and organization of cooperatives, general meetings, the managing committee, capital and financial affairs, accounts and audit, settlement of disputes, inspection and inquiry. Specifies that a cooperative may grant loans to its members as well as to another cooperative.

Incorporates three kind of cooperatives: agricultural cooperatives, special farmer's cooperatives, trading cooperatives. Regulates the registration of the statutes as well as the incorporation of cooperatives, subjected to the Minister approval. Provides for the contents of a statute and enumerates the circumstances under which cooperatives shall be dissolved. Establishes the powers of cooperatives and sets up restrictions relating to granting of financial assistance and to borrowing of money. Other provisions cover membership, capital and application of surplus, management of cooperatives, auditing, conversions and amalgamation, and winding up of cooperatives. Offences against this Act are criminally sanctioned. This Act repeals the Cooperative Societies Act No. 29 of 1939, the Cooperative Societies Amendment Act No. 44 of 1960, the Cooperative Societies Amendment Act No. 56 of 1963, the Cooperative Societies Amendment Act No. 65 of 1964, the Cooperative Societies Amendment Act No. 44 of 1975, the Cooperative Societies Amendment Act No. 69 of 1979.

Déclare que les dispositions de la présente loi sont également applicables aux unions de coopératives agricoles de services, dont la mission et l'organisation sont similaires à celles des coopératives agricoles de service.

Nomme un gérant chargé d'administrer les coopératives sous le contrôle de la commission des oeuvres sociales. Réglemente la responsabilité du gérant et du personnel des coopératives. Contient des dispositions relatives aux ressources financières des coopératives et aux excédents nets d'exploitation annuels versés aux fonds des oeuvres sociales. Attribue le contrôle des coopératives de consommation au ministre du commerce. Prévoit la dissolution et la liquidation des coopératives de consommation.

Conditions for registration include a membership of at least 20 founders members and the approval of the Ministry of Labour and Social Affairs. Provides for an executive body, elected by the general assembly, in charge of the day to day work of the society and its employees and representatives. Specifies that the Ministrer of Labour and Social Affair issues rules regulating the audit system for the society. The general assembly is the supreme authority of the society and sanctions all the matters related to the affairs of the society like- inter alia- the distribution of net surplus. Cooperative Societies are under supervision of the Ministry of Labour and Social Affairs. Other provisions cover the dissolution of cooperatives societies.

Resolución núm. 183/92 del Directerio del Instituto Nacional de Acción Cooperativa (INAC), por la que se reafirma el vínculo jurídico entre el asociado y la cooperativa de trabajo.

..."el vínculo jurídico entre el asociado y la cooperativa de trabajo es de naturaleza asociativa y está exento, por lo tanto, de toda connotación de dependencia, encuadrado en el derecho laboral". No obstante, se fijan los beneficios de seguridad social a que tienen derecho los asociados a las cooperativas de trabajo.

Se establece que el Poder Ejecutivo promoverá la constitución de asociaciones civiles, cooperativas, fundaciones o toda entidad de derecho sin fines de lucro para la solución de los problemas del hábitat popular o la realización de actividades de investigación científica o tecnológica o de enseñanza en relación a la tierra urbana o rural, vivienda, transporte, salud, servicios de infraestructura u otros aspectos en relación al tema.
