Regulates health and safety in fields of employment in which workers are exposed to lead and the possibility of lead poisoning. Defines the employments where workers are exposed to lead and the possibility of lead poisoning. Establishes the specific provisions employers must make in order to mitigate the possibilities of lead poisoning. These include inter alia, making workers aware of the dangers of lead poisoning and the means they have for protection, guaranteeing the safety of workers by using machinery which does not emit lead fumes, ensuring that lead particles are limited to 0.15 mg per metre cubed of air, and by placing machinery which uses lead at a safe distance from workers. Also prohibits the employment of workers under eighteen years of age in areas of work whereworkers are exposed to the threat of lead poisoning. Legislates that protective equipment must be made availableto workers. Provides for the periodic medical examination of workers to test for lead poisoning and the conditions of such medical examiniations. Requires employers to take all necessary measures in order to treat those workers who have been diagnosed with lead poisoning.

Las asociaciones sindicales propondrán al Ministerio de Trabajo una lista de personas, será el Ministerio quien habilitará a quienes considere idóneas, que actuarán con el nombre de Controladores Laborales y no tendrán relación laboral ni funcional con el Ministerio de Trabajo.

Entre los considerandos se dice que el alto índice de evasión de las obligaciones laborales existente y la injusticia y desprotección que esta situación implica para los trabajadores, sumado al drenaje de fondos destinados a la seguridad social, requieren organizar con urgencia estas funciones en el ámbito del Ministerio de Trabajo y Seguridad Social. Se agrega que "mediante el dictado de la presente norma, la República Argentina cumple con los compromisos contraidos por la Nación al ratificar los Convenios Internacionales del Trabajo sobre Inspección del Trabajo, 1947 (núm. 81), ratificado en 1954 y sobre Inspección del Trabajo (agricultura), 1969 (núm. 129), ratificado en 1982". El artículo 1 del decreto núm. 772/96 dispone que el Ministerio de Trabajo velará para que los distintos servicios de inspección del país cumplan con las normas que los regulan y, en especial, con las exigencias de los Convenios núms. 81 y 129. Cuando un Servicio Provincial de Inspección del Trabajo no cumpla con las exigencias de los Convenios núms. 81 y 129, el Ministerio de Trabajo elaborará un programa de reorganización.

To achieve these objectives, the labour inspector visits the enterprises from time to time and also must write an annual report for the ministry for labour and social affairs about such inspections. In the event that an employer does not pay attention to laws applying labour law standards, the inspector first requests that the employer stop violating these laws and if the employer still does not do so, the inspector takes the necessary occupational protective measures, and then gives the employer notice that it must pay a certain amount as a result of its illegal behaviour.
