Covers a broad range of labour matters including trade apprenticeship and training; the form and content of employment contracts and collective agreements; conditions of employment; social security and occupational health and safety. Specific provisions apply to women, young workers and disabled persons. Special terms are established for foreign organizations or individuals operating in Vietnam, foreigners working in Vietnam, and Vietnamese citizens working overseas. Requires that "the trade unions of the province" establish provisional trade union organizations at all enterprises currently operating without a trade union organization. Activities of such provisional trade union organizations shall be determined by the Government in conjunction with the Trade Union Federation of Vietnam. Sets out procedures for the resolution of individual and collective labour disputes.

Law No. 26 of 1995 on the environment protection. - Adoption: 1995-10-29 | YEM-1995-L-83565 This Law is composed of 5 Sections divided into 95 articles. Section I deals with terms and definitions and defines objectives of this Law which are: protection of environment; pollution control; protection, preservation and development of natural resources; protection of the society, public health, and all being livings from all dangerous and hazardous activities; protection of the national environment from external hazards activities; accomplishment of all international obligations relating to the environment protection and pollution control; and the contribution in the protection of ozone layer and climate. Section II provides for the following matters: water and soil protection; creation of protected areas; use, circulation, trade, registration, control, inspection of pesticides; and the issuance of licence for pesticides. Section III refers to the dangerous and hazardous activities to environment especially: control of activities that are dangerous and hazardous to the environment; laying down standards, criterion and technical requirements for the aforementioned activities; issuance of licences for and EIA for projects; trade and circulation of hazardous waste disposal; environment protection and economic development; and environment monitoring. Section IV pertains to marine pollution. Offences, penalties and compensations for environmental damages are given in Section V.

The Code shall apply to all workers except public servants, foreigners, casual workers, and domestic servants. Work is the natural right and duty of every citizen on the basis of equal conditions and opportunities without discrimination on the grounds of sex, age, race, colour, beliefs or language (Art. 5). Art. 11 establishes a Labour Council with the function of drafting labour law and policies and administering vocational training. Employers shall engage disabled persons up to a proportion of 5 per cent of their workforce (Art. 15). Non-Yemenis shall constitute no more than 10 per cent of any employer's workforce. Chapter II regulates contracts of employment, including collective agreements. Collective agreements which "damage the economic interests of the country" shall be invalid (Art. 32). Chapter IV covers employment of women and young persons. Women shall be equal with men in relation to conditions of employment and employment rights (Art. 42). Chapter V covers wages and allowances, including minimum wage and overtime; Chapter VI concerns hours of work. Chapter VII relates to work discipline and penalties; Chapter VIII to vocational training, including apprenticeships; Chapter IX to occupational safety and health; Chapter X to health insurance; and Chapter XI to labour inspection. Chapter XII covers labour disputes and strikes. Labour disputes which cannot be settled amicably must be submitted to an Arbitration Committee for resolution. Should arbitration fail, workers may proceed to a strike under specified conditions. Inter alia, individual workers must announce their intention to participate in a strike by wearing a red arm-band for three consecutive days before the commencement of the strike (Art. 146). Chapter XIII covers workers' and employers' organizations, and provides freedom of association.

S. 2 declares the city of Aden a free zone. S. 16 provides that projects operating in a free zone may not be nationalized or confiscated, or have their assets frozen or impounded save by a judicial order. Employers shall give priority to Yemeni workers (s. 17). The laws of Yemen shall apply in a free zone as long as they do not conflict with the Free Zone Law, and provisions of the social insurance law shall apply to Yemeni workers in the free zone, unless employers offer a more favourable insurance plan (ss. 33 and 35).

The Constitution of the Republic of Yemen [consolidated version]. - Adoption: 1991-05-16 | YEM-1992-C-29413 Consists of 5 Parts and 159 Articles. Article 1 defines the Republic of Yemen as an "Arab Islamic State" in which, according to Article 2 "Islam is the religion of the State" and the Shari'a is to be the foundation of the legal system and the legislation. Article 5 states that the political system shall be established on a political pluralism and multi-party basis. Part Two concerns the basic rights and obligations of citizens. Article 40 provides that all citizens are to be equal in rights and duties. In Article 57, the right to form associations and to be a member of political, professional, scientific, social and cultural associations and unions is acknowledged but this is done "to serve the objectives of the Constitution". Part Three regulates the distribution of State powers. Part Four governs the emblem, flag and national anthem of the Republic and Part Five concerns amendment to the Constitution and general provisions.

Adoption: 1978-04-30 | YEM-1978-L-5124 Provides in s. 5 that work is a right and an obligation, without any discrimination because of sex, age, race, colour, faith or language. Chap. II of Part II governs registration of work seekers and employment; no minors may be employed unless they have completed schooling (s. 19). Part IV sets standards for contracts of employment, and Part V details the system of work, rewards and penalties. Working hours and rest periods are covered by Part VI, and wages and allowances by Part VII. Part IX governs occupational health and safety, Part X social security and Part XI labour inspection. Procedures for the settlement of labour disputes are contained in Part XII, and Part XIII governs trade unions and their activities. Workers have the right to form their own organisations (s. 93); the functions of trade unions are set forth in ss. 94 and 95. Penalities for infringements of the law are contained in Part XIV.
