    Rules and Regulations implementing Republic Act No. 6715.

    These Rules and Regulations amend the Rules implementing Presidential Decree No. 442 (the Labor Code; LS 1974-Phi.1A) in consequence of Republic Act No. 6715. A new Rule XI, on the adjudicatory powers of the Department of Labor and Employment, is incorporated in Book III of those Rules. Rules XI, XII and XIII of Book III are hereby renumbered accordingly. In Book V, the rules are recast in regard to definitions, union registration, representation cases, internal-union disputes, elections, registration of collective bargaining agreements, voluntary arbitration, the labour-management council and picketing, strikes and lockouts. A strike or lockout may be declared in case of a bargaining deadlock or an unfair labour practice, as further defined (Book V, Rule XIII, s. 40). The Rules also govern improved offer balloting and execution of decisions, awards and orders. (LLD-1990/1)

    Act amending the Labor Code (R.A. No. 6715). - Legislation on-line

    This Act amends the Labor Code (Presidential Decree No. 442; LS 1974-Phi.1A) to overhaul the law governing strikes and to promote collective bargaining and voluntary dispute settlement. It adds a new Title VII-A, "Grievance machinery and voluntary arbitration," to the Code. Fresh provision is made for the National Labor Relations Commission, which is empowered, inter alia, to review cases decided by "labor arbiters". The Bureau of Labor Relations is charged with registering "legitimate trade unions", whose rights are spelled out, and maintaining a file of collective agreements. The amendments set forth procedures to follow in collective bargaining, and increase the term of agreements from three to five years. An employee in regular employment is not to be dismissed except for just cause or as authorised by the new provisions. Written notice of termination is henceforth required. Finally, the Act strengthens protections for wage claims in case of bankruptcy. (LLD-1990/1)

    Executive Order No. 111 amending certain provisions of the Labor Code, as amended.

    These amendments primarily address trade union representation and procedures governing the right to strike. The Order also amends ss. 60 and 61 regarding the employment of apprentices and the contents of apprenticeship agreements, as well as s. 128(b) regarding powers to order compliance with labour standards. The Order replaces the provisions on state policy towards the labour movement (s. 211(c) of the Labor Code (LS 1974 - Phi. 1A (published as s. 210(c))) and changes one of the registration requirements for labour organizations (s. 234(c) (published as s. 233(c))). It amends s. 245 on the right of employees in the public service to organize and bargain collectively and ss. 257 and 258 on representation issues in organized establishments and petitions in unorganized establishments. Sections numbered in the Order as s. 264(c) and (f) and s. 265(d) address the filing of a notice of a strike or lockout and cooling-off periods, the requirements for a decision to declare a strike or lockout, and the prohibition placed on public officials to introduce or escort replacements for strikers. The provisions of ss. 238 and the second paragraph of ss. 239 and 241 (published as ss. 237, 238 and 240) on the structuring of the labour movement are repealed, as is Letter of Instruction No. 1458 to the extent indicated in the Order. The Order becomes effective 15 days after publication in the Official Gazette.

    Amends provisions of the Labor Code relating to, inter alia, registration of trade unions and collective agreements. Amends s. 249 to prohibit interference or discrimination by an employer based on an employee's legal participation in labour activities; equally, amends s. 250 to prohibit interference or discrimination on the part of a trade union. Prohibits strikes or lock-outs in vital industries, which include enterprises engaged in education, communication, transport, banking and distribution of fuel. If arbitration fails, workers not engaged in a vital industry may strike; the President, however, may refer the labour dispute to compulsory arbitration. Workers participating in illegal strikes may be terminated. Also contains provisions relating to conditions under which employers may legally terminate employment (redundancy, disciplinary reasons).

    Articles 9 and 10 amend the Labor Code to put it into line with the Code of Agrarian Reforms. The amendments deal with determining cost of land and ownership of land for tenant farmers. Title is not to be conferred on a tenant farmer unless they are full members of a duly recognized farmers' co-operative.

Book Two regards human resources development, apprentices, disabled workers, and the National Manpower Development Program. Book Three covers conditions of employment, hours of work, wages, women and young workers, and domestic workers. Book Four provides for Health, Safety, and Social Welfare benefits. The 1998 Labor Code published by the Philippine Law Gazette incorporates most labour legislation into one Code, and contains more recent legislation as separate appendices.
