    Article 3 For the purpose of implementing the provisions of this Law:

    a.person with a disability is defined as a person who has long-term physical, sensory, intellectual, mental, psychological or neurological impairment, which, as a result of interaction with other physical and behavioral barriers, may hinder performance by such person of one of the major life activities or hinder the exercise by such person of any right or basic freedom independently.

    b. An impairment will be considered of a long-term nature according to Clause (a) of this Article if the impairment is not expected to disappear in at least (24) months from the date of commencement of treatment or of rehabilitation.

    c. Physical obstacles and behavioral barriers mentioned in Clause (a) of this Article include lack or absence of reasonable accommodation or accessible formats or accessibility, and also include individual behaviors and discriminative institutional practices on the basis of disability.

    d. Major life activities mentioned in Clause (a) of this Article include the following: 1. Eating, drinking, administering, self- care, reading and writing. 2. Movement and mobility. 3. Interaction and concentration, expression and verbal, visual and written communication. 4. Learning, rehabilitation and training. 5. Work.

    Regulates the private offices of recruiting Non-Jordanian Domestic Workers.
    Requires employers to purchase insurance from any legally licensed company that will cover the householder (employer) for financial losses resulting from the worker leaving or ‘refusing to work’. In addition, recruiters are bound to replace domestic workers for employers in three circumstances. Firstly, recruiters must replace those who ‘refuse to work’ for their new employer during the first 30 days at no further cost to the householder and on condition that the original recruit is ‘transferred outside of the country’. Secondly, where a migrant worker fails to arrive in Jordan whether by choice or not, recruiters must provide their employer with a replacement domestic worker at no additional cost. Thirdly, the responsible recruiter must also replace a domestic worker if the employer finds her to be pregnant or are otherwise certified as unfit by the Ministry of Health. However, recruiters are not legally responsible for replacing a domestic worker if employers have caused her to leave their employment, such as in cases where they have assaulted the worker.

    The new Regulations amend article 2(a) of the Regulations of 1999 and provide that private employment agencies may charge fees from workers they help to place as follows: 5 per cent of the wage value of the contract concluded between the employer and the assisted worker. This percentage should be reduced by 1 per cent with every new contract. For purposes of calculating these percentages contract periods must not exceed 12 months each.

    Provides for the adoption of a wide range of measures to assist the disabled and uphold their rights to education, training, medical care and employment. Enterprises employing between 25 and 50 workers must employ at least one disabled person; those employing more than 50 workers must include at least two per cent disabled staff in their workforce. Provision is made for the establishment of the National Council for Protection of the Disabled, an inter-ministerial authority responsible for general policy-making in the fields of protection, rehabilitation and education; drafting regulations under the Act; preparing rehabilitation programmes and special educational curricula; etc.

    Establishes the Development and Employment Fund, a fund vested with legal personality and enjoying full financial independence. The objective of the Fund is to create productive employment for low-income individuals, families and communities and the unemployed through direct or indirect financial assistance, training schemes and other projects.
