    General provisions cover the definition of cooperatives, membership, and shares. It sets forth the establishment of cooperative societies, which include by-laws and registration. Sets up the General Assembly who consists of all members of the Society. Specifies that each Society shall have a Management Committee to follow up the preparation of reports and final accounts, and a supervisory Committee to control the functioning of the society's operations, by-laws and decisions of the General Meeting. Provisions are made for the distribution of surplus and the reserve fund. The Ministry of Labour and Social Affairs has the right to supervise all kinds of cooperatives through its inpectors as for example to stop the execution of any cooperative decision if it is against the cooperative law or cooperative principles. It finally deals with Secondary Societies, Cooperative Unions, as well as the liquidation and cancellation of cooperative societies.

Other provisions cover the property and funds of cooperative societies, distribution of profits, privileges, liabilities and obligations of members of cooperative societies, audit, inspection and inquiry, settlement of disputes, winding up and dissolution of cooperative societies. An entire chapter deals with special provisionss for cooperative land mortgage banks, central societies and national societies. Provisions are made for the enforcement of obligations and the recovery of sums due. Regulates jurisdiction and appeal, offences, penalties and procedure.

The former Co-operative Societies Act is repealed (Cap. 378).

    La citada ley modifica la Disposición Transitoria Primera de la Ley núm. 356, de 11 de abril de 2013, General de Cooperativas, imponiendo a las cooperativas que se encuentren registradas y en funcionamiento la obligación de adecuarse a las disposiciones de dicha ley antes del 13 de mayo de 2018, bajo apercibimiento de cancelarse las autorizaciones no ratificadas y ordenarse la disolución, liquidación y extinción de tales cooperativas. Asimismo, incorpora una Disposición Final única, en la que se ratifica el respeto en las cooperativas de los derechos sindicales, laborales y de asociados de los sindicatos que incluyan asociadas y asociados pre-existentes a la promulgación de dicha Ley, así como de los que fueren a constituirse a futuro en los sectores de Servicios y Servicios Públicos.

    This Act, repealing the Cooperative Societies Act, chapter 42:03, of 9 April 1964, provides for the powers of the Minister to foster and encourage development. Sets forth the appointment of a Commissioner for Cooperative Development whose mission is mainly to encourage the formation of cooperative societies by providing information on cooperative principles and to provide advice and training for officers of cooperative societies, their members and employees. Regulates the registration of cooperatives which respect basic cooperative principles hereby enumerated. Entitles all societies to form secondary societies to facilitate their operations or to provide other services as may be necessary for their members. Other provisions cover qualification for membership and expulsion of such members. Specifies that the supreme authority of cooperatives shall be vested in the general meeting of members. Enumerates the duties of such meetings and provides for the election of a Committee of Management. Provisions are made for the establishment of a Statutory Reserve Fund and the division of net surplus among members. Regulates loans made by societies, deposits, investments of funds and restricts capital expenditure. Appoints an external auditor who shall make reports to members. Provides for the amalgamation and division of cooperatives, for the settlement of disputes and for the liquidation of cooperatives.

    Dispone sobre la contribución de los afiliados a cooperativas de trabajo y producción para el financiamiento de la jubilación especial y del adicional en la retención sobre servicios prestados en calidad de mano de obra. Asimismo, regula el reconocimiento de las prestaciones monetarias de los contribuyentes individuales que prestan servicios a empresas, la extinción de la escala transitoria de salario base y el procesamiento electrónico de datos para el registro de la escrituración contable y financiera. Por último, introduce modificaciones a la Instrucción Normativa INSS/DC núm. 68, de 10 de mayo de 2002.
