    The Regulations prescribe the criteria and methodology for assessing work of equal value contemplated in section 6(4) of the Employment Equity Act which was amended by Act No. 47 of 2013. It sets out the obligations of employers with respect to ensuring that unfair discrimination, including wage discrimination, is eliminated in the workplace with respect to work of equal value including but not limited to eliminating wage discrimination based on race, gender or disability. The regulations define what is meant by work of equal value and also provide factors which may justify differentiation in terms of employment conditions. In order to ensure that the regulations are implemented, there are a number of obligations that employers must comply with including the drafting and implementation of an Employment Equity Plan, as provided for in the Act, as well as reporting obligations to the competent authorities. Enforcement is undertaken through the issuing of written undertakings and compliance orders by the Labour Inspectors or the Director-General Review Process.

    Makes numerous amendments to the Employment Equity Act. Includes amendments to certain definitions. Amends section 6 by extending the scope of discrimination to include discrimination on "any other arbitrary ground". It in particular adds a new subsections (4) and (5) to section 6. Section 8 is amended concerning psychometric testing. Section 10 is also amended concerning dispute resolution with special provisions in the case of sexual harassment in the workplace as well as wage discrimination. The Act also amends section 11 (burden of proof), minor wording changes in sections 15, 16, and 19, section 20 (failure to implement employment equity plans), section 21 (reports), section 27 (income differentials and discrimination), section 36 (undertaking to comply), section 37 (compliance orders), sections 39-40 (repeals both sections), section 42 (assessment of compliance), section 45 (failure to comply with Director-General's request or recommendation), section 48 (introduction of new subsection (2)), section 50 (fines), section 53 (code of good practice), sections 55-57, 59, 61, and section 64A (inserts new section on the amendment of annual turnover thresholds in Schedule 4). Also repeals and replaces Schedule 1 concerning maximum fines and Schedule 4 concerning turnover threshold applicable to designated employers.

    To amend the Basic Conditions of Employment Act, 1997, so as to substitute certain definitions; to prohibit employers from requiring employees to make payments to secure employment and from requiring employees to purchase goods, services or products; to prohibit anyone from requiring or permitting a child under the age of 15 years to work; to make it an offence for anyone to require or permit a child to perform any work or provide any services that place at risk the child's well-being; to provide for the Minister to publish a sectoral determination for employees and employers who are not covered by any other sectoral determination; to provide for the Director-General to apply to the Labour Court for an employer to comply with a written undertaking by the employer; to provide for a compliance order; to delete certain obsolete provisions; to provide the Labour Court with exclusive jurisdiction in respect of certain matters; to provide for certain offences and penalties; to increase the penalties for certain offences; and to provide for matters connected therewith.
