    Amends Insolvency Act, 1936. Requires notice of petition for the sequestration of a debtor's estate to be given to employees of debtor, registered trade unions representing such employees, the South African Revenue Service and the debtor. Also amends Companies Act, 1973, so as to require notice of an application for the winding-up of a company to be given to employees of the company, registered trade unions representing such employees, the South African Revenue Service and the company.

    Inter alia, amends the Insolvency Act 1936 to stipulate that any balance of free funds of a bankrupt enterprise shall be applied to pay any wages, amounts due in respect of leave, or severance pay due to any employee for a period not to exceed three months. Also makes amendments to the Supreme Court Act 1959, the Criminal Procedure Act 1977, the Attorneys Act, 1979, the Co-operatives Act, 1981, the Magistrates Act, 1993, the Special Investigating Units and Special Tribunals Act, 1996, and the National Prosecuting Authority Act, 1998.

    Provides for certain matters relating to the conditions of service of employees of the South African Transport Services (categories of employment, salary adjustments, employment injury compensation, non-discrimination on the basis of colour, race or sex in appointments (s. 3(7)), discipline, etc.). Establishes the Labour Council, the objects of which are to maintain and promote labour peace and prevent labour disputes by means of collective bargaining, referral to mediation, arbitration or other procedure (s. 8). Strikes are prohibited (s. 21). Repeals, inter alia, the Conditions of Employment (South African Transport Services) Act 1983.

Supersedes Government Notice No. R. 1817 of 4 Sept 1981, as amended.

    Government Notice No. R. 2424: Exemption from the application of the Basic Conditions of Employment Act 1983 and Wage Act 1957.

    The decision refers to the special work-creation programme announced in October 1985. Employers engaging persons in approved projects under the programme are exempted from compliance with the basic conditions of employment as regards minimum wages, annual and sick leave, piece work and commission work and termination of employment. The decision was taken by the Director-General for Manpower.

    Act to amend the Basic Conditions of Employment Act 1983 [LS 1983 - SA 1], so as to further define "public holiday" and "wage"; to provide that notice of termination of service during the first four weeks of service shall in the case of a written contract of employment be given in accordance with such contract; to make the non-payment or underpayment of wages an offence; to exclude from the prohibition on deductions from employees' remuneration the setting-off against such remuneration of amounts owed by an employee to his employer; and to effect certain textual improvements; and to provide for incidental matters.

    Act to amend the Wage Act 1957 [LS 1957 - SA 1], so as to provide that a determination shall not apply to a person in respect of any matter regulated by any order which is binding on such person in terms of the Labour Relations Act 1956; to authorize the board to gather information in respect of any trade and to advise the Minister in relation to the exercise of the power mentioned in section 4(1); and to provide that the chairman or the temporary chairman of the board may, without the decision of the board, decide that any investigation and report contemplated in section 4(1) shall be carried out and made by any member of the board, either alone or in conjunction with any additional member; and to provide for matters connected therewith.     Consolidates and amends the law relating to the establishment of a wage board, the determination of terms and conditions of employment and other incidental matters. Does not apply to, inter alia, employment in farming or in domestic service in private households, public servants, or to employees within the public educational system.
