    This Act sets out measures for the management, control and improvement of the banana industry in Saint Vincent and the Grenadines.
    The Minister of Agriculture shall be responsible for the general administration of this Act. Within the Ministry of Agriculture a Banana Division shall be established. The Minister shall cause a Register of Banana Farmers to be established and maintained. The Act sets out the criteria and procedures for registration. Authorized officers may enter banana plantation for inspection. The Act further establishes the Banana Industry Fund and a Consultative Committee on the Banana Industry, provides for the licensing of exportation of bananas and grants regulation-making powers to the Minister.

The employers is also to distribute service charges to a hotel worker pursuant to an agreement between the employer and the hotel worker. Repeals the Wages Regulation (Hotel Workers) Order, 2003 (No. 14 of 2003).

    Sets out the minimum wages to be paid to a shop worker in the Schedule to the Order. Provides that a shop worker shall work eight hours per day inclusive of one hour for lunch. A watchman is to be employed for twelve hours per day for a period of six days. The overtime wages, vacation, sick leave, and maternity leave of a shop assistant is set out in the schedule. An employer is to observe health and safety requirements by providing at least two yearly checks by a duly qualified medical practitioner at the expense of the employer to all food handlers. Repeals the Wages Regulation (Shop Assistants Workers) Order 2003 (No. 18 of 2003).

    The Regulations contain rules relative to handling of fish on board of vessels, freezing or chilling of fish on vessels, hygiene conditions in handling and processing of fish in establishments, monitoring of conditions of production and HACCP, storage and transportation, packaging and labelling, inspection and sampling. They also prescribe standards for the chilling, freezing, smoking, canning and other processing methods of fish, the keeping of live fish and provide for the marketing of live fish and the approval of fish processing establishments.     This Act contains rules for the public management and disposal of solid waste as defined in section 2 and including hazardous waste as defined in Schedule 1 to this Act, and provides for appointment, functions, etc. of the National Solid Waste Management Authority.
    The Act consists of 49 sections divided into 7 Parts: Preliminary (I); The National Solid Waste Management Authority (II); Waste management planning (III); Environmental impact assessment (IV); Waste management licences and permits (V); Waste management operations (VI); Financing and cost recovery (VI); Miscellaneous (VII).
    The Central Water and Sewerage Authority is appointed as National Solid Waste Management Authority under section 3. Functions of this Authority are set out in Schedule 3. All solid waste management facilities including land on which they are situated shall be vested in the Authority. The Authority shall draft an inventory of solid waste generated in Saint Vincent and draft a solid waste management strategy and implementation programme in accordance with indications et out in section 6 (sect. 5). An environmental impact assessment shall be carried out in accordance with sections 13 to 18 before establishment of a solid waste management facility. Section 19 of Part V prohibits the deposit of solid waste on indicated lands and waters and requires a licence to be obtained for the construction and operation of any waste management facility. A licence shall also be required for existing facilities pursuant to section 20. Section 31 defines the liability of holders of licences in case of accidents causing damage to health or the environment due to failure of the licence holder. Provisions of part VI regulate the importation, processing and other handling of waste. Only waste listed in section 33 may be imported into Saint Vincent.

    The Act provides for the regulation of activities that may affect public health and the environment. The Minister of Health is charged with the responsibility of protecting and promoting public health by providing for ensuring conservation and maintenance of the environment (sect. 3). The Minister may delegate functions pursuant to section 4. An Environmental Health Board is established under section 5. The Board shall advise the Minister on matters relating to environmental health. An Environmental Health Division is established in the Public Health Department and a Chief Environmental Officer shall be appointed (sects. 6 and 8). The functions of the Division are set out in section 7. Sections 10 to 13 prescribe certain requirements regarding observation of environmental norms by the public. Powers of the Chief Environmental Officer and other public officers are defined in section 13 to 16. Appeal against decisions or notices made under section 6 may be had in accordance with sections 17 to 20. Sections 21 to 30 prescribe offences. In particular, authorises the adoption of regulations on, inter alia, the registration and licensing of fishermen and fishing vessels, and standards and other measures for the safety of local fishing vessels and fishermen. Repeals the Fishing Industry Act 1961 (No. 19), among others.
