    Act to qualified non-attorney representatives.

    Clarifies and reiterates who is covered by the law's civil rights protections. The Act revises the definition of "disability" to more broadly encompass impairments that substantially limit a major life activity. The amended language also states that mitigating measures, including assistive devices, auxiliary aids, accommodations, medical therapies and supplies (other then eyeglasses and contact lenses) have no bearing in determining whether a disability qualifies under the law. Changes also clarify coverage of impairments that are episodic or in remission that substantially limit a major life activity when active, such as epilepsy or post traumatic stress disorder.

    Amends hearing loss recording provisions of Occupational Injury and Illness Recording and Reporting Requirements rule published on 19 January 2001 (66 FR 5916-6135). Revises criteria for recording hearing loss cases in several ways, including requiring recording of standards threshold shifts that have resulted in a total 25 dB level of hearing above audiometric zero, averaged over frequencies at 2000, 3000 and 4000 Hz, beginning in year 2003.

Also liberalizes provisions that provide an impairment-related work expense exclusion from the regular SSI income counting rules.

    Reauthorizes the Act through 1996. Services must be provided to a developmentally disabled individual in accordance with the individual's unique needs. The Secretary of Health and Human Services will make grants to public and private entities for projects of national significance to individuals with developmental diabilities, which projects do not discriminate on the basis of race or ethnicity.

These final regulations further amend the regulations implementing the State Vocational Rehabilitation Services Program, the Program of Special Projects and Demonstrations for Providing Transitional Rehabilitation Services to Handicapped Youth, and the Program of Special Projects and Demonstrations for Providing Supported Employment Services to Individuals with Severe Handicaps and Technical Assistance Projects in order to make conforming changes to the regulatory requirements for these programs.

    Enforcement of Nondiscrimination on the Basis of Handicap in Equal Employment Opportunity Commission Programs Rule (29 CFR Part 1615)

    Provides for the enforcement of section 504 of the Rehabilitation Act of 1973, as amended, which prohibits discrimination on the basis of handicap, as it applies to programmes or activities conducted by the Equal Employment Opportunity Commission. It sets forth standards for what constitutes discrimination on the basis of mental or physical handicap, provides a definition for "individual with handicaps", and "qualified individuals with handicaps" and establishes a complaint mechanism for resolving allegations of discrimination.
