Act requires promulgation of guidelines for determining whether an individual with cancer shall be found "at least as likely as not" to have sustained that cancer from exposure to ionizing radiation in the performance of duty for nuclear weapons production programs of the Department of Energy and its predecessor agencies. Guidelines will be applied by Department of Labor, which is responsible for determining whether to award compensation to individuals seeking federal compensation under the Act.

    Promulgated by the Occupational Safety and Health Administration (OSHA). Directs OSHA to revise the Bloodborne Pathogens standard to include new examples in the definition of engineering controls along with two new definitions. Exposure Control Plans shall reflect how employers implement new developments in control technology. Also, employers shall be obliged to solicit input from employees responsible for direct patient care in the identification, evaluation, and selection of engineering and work practice controls. Finally, certain employers shall be required to establish and maintain a log of percutaneous injuries from contaminated sharps.

    Addresses employee exposure to ergonomic risk factors in jobs in general industry workplaces. Contains "action trigger" which identifies jobs with risk factors of significant magnitude, duration, or intensity to warrant further examination by the employer. If an employee reports a musculoskeletal disorder (MSD) incident and the risk factors of that employee's job meet the action trigger, the employer must establish an ergonomics programme for that job. Specifies the content of this programme.

Requires employers to establish or maintain a respiratory protection programme for respirator-wearing employees. Also provides for employee training, fit testing, medical evaluation, and respirator use and cleaning. Also requires the use of a self-contained breathing apparatus during interior structural firefighting; furthermore, two firefighters must be on standby to provide assistance or perform rescue when two firefighters are inside a burning building.

The Table is also amended to lift judicial stays for certain industries. Industries affected by the lifting of the stay must implement engineering and work practice controls in accordance with paragraph (e)(1), as amended.

MSHA retains existing provisions related to repirators. Under the NIOSH rule, MSHA retains joint approval responsibility for certain mining-related respiratory protective devices.

    Authorizes funds through 1997 for implementation of the Hazardous Materials Transportation Act. Provides for the Secretary to issue a regulation to specify the minimum safety information that a carrier must request from a prospective motor vehicle driver. Carriers will no longer be required to file rates with the Interstate Commerce Commission, and the ICC may suspend the commercial activities of a carrier for safety reasons.
