    Repeals the Children Act (Chap. 46:01)

    With respect to the amendments, the Education Act is amended increasing compulsory schooling for children aged from five to sixteen years old. The Liquor Licences Act (Chap. 84:10) is prohibiting the use of children to sell, buy or deliver alcohol. Also amends the Tobacco Control Act making it an offence to use a child to buy, sell or deliver any tobacco product. Under the Trafficking in Persons Act, the definition of "child pornography" is extend.

    Also amends the Summary Courts Act (Chap. 4:20); the Bail Act (Chap. 4:06); and the Sexual Offences Act (Chap. 11:28).

    This Act has effect even though it is inconsistent with sections 4 and 5 of the Constitution. Makes numerous amendments to the Act, including definitions and terms of reference. Inserts a new section 3A concerning objectives of the Act and replaces section 5 concerning powers and functions of the Authority and section 5A concerning powers with respect to adoption procedures. Also amends sections 6, 7, 7A, 8 and 9 concerning the duties of the Authority and section 11 concerning the composition of the Authority. Repeals sections 12, 13, 15, 29, 35A, 37(3), 43(2) and 43(3). Amends section 14 concerning Assessment and Support Centres and Reception Centres. Also makes amendments to sections 17, 18, 19, 22, 23, 24, 25 (family assistance orders etc.), 26-27 (guardianship), 28, 30, 31, 32, 33, 34, 35, 36, 39, 40, 41, 44, 46 and 50. The Schedule to the Act is also repealed and replaced.

    Provides that a person under the age of 16 shall not be admitted to employment. Amends the Factories Ordinance (section 3) and the Children's Act (section 2) in accordance with this Act. Also amends the Children's Act with respect to: section 91 concerning restrictions on employment of a child under the age of 16 years; section 92 concerning keeping of a register by employers for persons under the age of 18 years; repealing section 93; amending section 94 concerning liability of parents and employers; section 95 by deleting the word "twelve" and substituting the word "sixteen"; and section 96 concerning Penalties. Also amends the Recruiting of Workers Act by repealing section 5 and section 108(1) of the Shipping Act.

Authority also investigates complaints of staff, children, and parents or guardians of children. Part III contains provisions regarding children in need of care and protection. Part IV regulates care of children under Authority; Part V maintenance of children in care. Part VI contains financial provisions, and Part VII miscellaneous provisions.

Responsibilities of Board include making of recommendations to court as to whether in its view adoption is in the best interest of the child whose adoption is sought. Part III regulates arrangements for adoption. Part IV provides for freeing of child for adoption. Parts V and VI deal with issue, registration and effects of adoption orders. Part VII provides for overseas adoption. Finally, Part VIII contains miscellaneous provisions.
