    Ministerial Regulation No. 13 (B.E. 2543) issued under the Labour Protection Act, B.E. 2541.

    Provides that the employer and the employee shall agree on the normal working hours by specifying the time of commencement and end of work. In one day it shall not exceed twelve hours, and total working hours in one week shall not exceed forty-eight hours. Also makes provision for determination of wages in case the agreed time for normal working day exceeds eight hours.

    Establishes labour protection measures for work in petroleum operations under the law governing petroleum, as well as professional, technical and administrative work conducted in conjunction with such activities. Limits the total number of working hours for employees in jobs of the latter nature to 48 hours per week.

    Provides that normal hours of work of all types of employment shall be eight hours per day. Fewer hours shall be the norm for work which is dangerous, including underwater or underground work, work involving radiation, metal welding, dangerous substances, or vibrating machinery, and work performed in extreme heat or cold.

    Provides that overtime hours and hours worked on a holiday shall not exceed in total 33 hours per week.

    Provides that employers who run hotels, theatres, restaurants, bars, clubs and other services for tourists shall not be obliged to give their employees time off on traditional holidays. The same shall apply to employers in remote locations and in cases where work cannot be interrupted because doing so would result in damage.

    Provides that where the work is of a continuous nature which will be damaged if interrupted, or in case of emergency where the work cannot be stopped, the employer may call upon the employees to work outside or longer than regular working hours or to work on holidays if deemed necessary.

    Specifies amount of minimum wages for each province and establishes standard hours of work depending on the nature of work and the economic sector in which it is performed. Provisions are made for remuneration in respect of overtime.

    Amends the Announcement of the Ministry of the Interior respecting Labour Protection (LS 1972-Thai. 2 ) by eliminating the distinction between permanent and temporary employees. Modifies ss. 32, 33 and 33bis relating to holiday pay, sick pay and pay for military service leave. Revises provisions on severance pay (ss. 45 to 47 and 75), with benefits depending upon length of service; persons performing occasional or seasonal work and persons having engaged in certain acts are excluded from severance pay provisions.

    This Notification, which does not apply to agricultural work or other work as prescribed by the Ministry of Interior, prescribes the minimum monetary daily wage and maximum daily work hours for certain classes of employment: seven hours per day in respect of work that might be harmful to the health or body of the worker, eight hours per day in respect of industrial or transportation work, and nine hours per day for commercial work.

    Inter alia, repeals the Act on Settlement Procedures for Labour Disputes of 1958. Authorises the Ministry of Interior to prescribe measures for labour protection in regard to working hours, rest periods, holidays, etc.; work by women and children; minimum wages, compensation for occupational injuries or diseases; and health and safety (s. 2). Establishes a Compensation Fund in the Labour Department (s. 3). Provides for the appointment of an attorney for an indigent employee with a prima facie case against his or her employer (s. 6). Sets forth penalties and addresses other matters.
