The Trade Unions Act, 1992 Adoption: 1992 | SDN-1992-L-31293 In 1989 all existing trade unions and associations were dissolved pending the promulgation of this Act, which adopts a new definition of "worker" that eliminates occupational distinctions, and gives each enterprise single union representation. The Minister of Justice is to issue regulations specifying the enterprises and sectors in which workers may establish trade unions. Workers who wish to form a trade union must form a preparatory committee on which all the constituents of the proposed union are represented. This committee is responsible for drawing up the constitution of the trade union. No sector or enterprise may be organised by more than one union, and the Registrar has the power to suspend the activities of any trade union committee if he considers that it is in breach of the law. The Act also provides for the formation of national trade union federations and national general professional associations, registration and dissolution of trade unions, and for transitional matters.

Also enumerates the responsabilities of this Preparatory Committees and emphasizes that those persons who have been arrested for non-trade union activities shall not be allowed to participate in the Preparatory Committees.

Adoption: 1989-06-30 | Date of entry into force: 1989-06-30 | SDN-1989-R-42861 Dissolves all political parties and stipulates that their properties are to be confiscated by the state. Suspends the governments of regions and departments as well as several other bodies such as trade unions and non-governmental organisations. Prohibits further publication of the existing press until a new licence is issued by a competent body. Transfers so-called emergency powers, which are enumerated in this decree, to the chairman of the revolution council, applicable in conjunction with the state of emergency which has been declared throughout the Sudan. Any resistance against the provisions of this decree may be punished with imprisonment.

Decree to abolish the Trade Unions Law of 1987. Adoption: 1989 | SDN-1989-R-42857 This Act abolishes the Trade Unions' Act 1987 pursuant to the Third Constitutional Decree of 1989. Appoints a so-called Registrar-General for Trade Unions with the status of Chief of Department in the Attorney General's Office whose main tasks consists of supervising the preparatory committees responsible for the work of Trade Unions and to prepare the formation of new committees on trade unions in accordance with new legislation.
