The Sudanese Nationality Act of 2011 amends the Sudanese Nationality Act of 1994. -

The Sudanese Nationality Act of 2011 amends the Sudanese Nationality Act of 1994 as follows:

Section 6 of the Sudanese Nationality Act of 1994 is amended as follows:
1- The phrase "granting and revocation" is added to the title of the Section before the phrase nationality certificate.
2- A new sub section 2 is added to the section which reads as follows:
"2- The Minister may decide to revoke Sudanese nationality by birth if the person has obtained it by fraud, forgery, false representation or the concealment of any material fact; or any other unlawful way".

Sub section 1 of section 7 of the Sudanese Nationality Act of 1994 is amended as follows:
1- Sub section (c) is amended by adding the phrase "continuous and lawful residence": after the phrase "residing in Sudan".
2- The following two sub-sections should be added after sub-section (d), as follows:
"(e) To be of a sound mind".
"(f) To have a lawful way of gaining living".

Section 10 of the Sudanese Nationality Act of 1994 is repealed and replaced by the following new section: "Loss of Nationality".

Section 11 of the Act is amended by adding the following new sub-section to item (1) after sub-section (f)accordingly it will read as follows: "(g) He has made a written request or a declaration renouncing his Sudanese nationality".

The following new section shall be added after section 15 of the Act, it reads as follows:"Reinstatement of nationality"

Section 18 of the Act is amended as follows:
1- The phrase "without prejudice to any severe punishment" shall be added to the preface of the section before the word "punishes"
2- The word "fails" in sub-section (d) from the section should be replaced by the word "refuse".
3- The following new sub-sections shall be added to the section after sub-section (d), it reads as follows:
(e) Obtains a Sudanese certificate by fraud, false representation or the concealment of any material fact; or any other unlawful way.
(f) Violates any of the provisions of this Act.

The Government of Qatar and the Republic of Sudan ratified the additional Protocol of the Convention governing the use of Sudanese workers, signed in Doha on 26/04/2010.

The additional Protocol regulates aspects of the immigration of workers between Qatar and Sudan. It provides the Government of Qatar with the right to return any employee whose work permit has expired or if the behavior of the employee is contrary national security.

Chapter Five establishes the Humanitarian Aid Commission and sets out its jurisdiction and powers as well as the establishment of a General Commissioner. Chapter Five deals with violations, penalties, punishment and appeals. Finally, Chapter Six contains general provisions including on accounts, reports etc of NGOs and charitable organisations. Chapter I contains provisions concerning scope of application and entry into force of the Act.
Chapter II covers Child Protection and functions of the secretariat.
Chapter III deals with Child Protection Councils in the provinces.
Chapter IV concerns medical care of children and includes provisions concerning periodic medical examinations, right to breast feeding and right to psychological care.
Chapter V contains measures with respect to the establishment and running of nurseries.
Chapter VI deals with education.
Chapter VII provides for the cultural welfare of children including establishment of libraries and the prohibition of certain publications and shows.
Chapter VIII deals with the employment of children and refers to the Labour Code of 1997 (section 31). It prohibits the employment of children in any forced labour, sexual, pornographic exploitation, illegal trafficking and their exploitation or use in armed conflicts (section 32). It also sets out the daily hours of work for children, which is not to exceed six hours with one or two rest periods whose total is a minimum of one hour. A child is not able to work more than four consecutive hours and can not stay at the workplace for a period which exceeds seven hours (section 33(a)). Also deals with the handing of wages to a child (section 34) and the training of children (35).
Chapter IX deals with care of children with special needs.
Chapter X concerns the care of delinquent children including welfare and reform measures.
Chapter XI contains procedures for the judicial examination and treatment of minors including arrest, examination, trial and sentencing.
Chapter XII contains provisions on general provisions on penalties for delinquent children.

Part I provides that the Sudan shall be a federal republic in which "religions conciliate." Part II sets forth freedoms, rights, and duties, which shall include the right to equality (discrimination on the basis of sex, race, or religion shall be prohibited), freedom from forced labour, and freedom of association (Art. 26).The Executive shall consist of a President who is elected for a five-year term, two Vice Presidents, and a Council of Ministers; on the local level, executive authority shall rest with Governors. The National Assembly (Part IV) shall have legislative authority. The judicial system, outlined in Part V, guarantees the independence of judges and provides for the Constitutional Court. Part VIII provides the President with the power to declare a state of emergency, under which the President may suspend constitutional freedoms, except for freedom from slavery and torture and the right to non-discrimination. All previous Constitutional Decrees (except Decree No. 14) are repealed; all other laws, however, shall continue to be in force. Approved by national referendum 24 June 1998.

Declares that the Sudan is a "multi-racial, multi-cultural and multi-religious state" and provides for freedom of religion and independence of the judiciary. Defines federal and state powers and establishes a Southern States Coordinating Council to govern southern states and arrange local elections.

Applies to all workers except civil servants, members of the armed forces, domestic servants, agricultural workers, family members of an employer, and casual workers. Chapter 2 establishes a Manpower Federal Committee. Chapter 3 governs employment agencies, private employment agencies, recruitment, apprencticeships, and registration of workers. Sudanese seeking jobs outside of Sudan shall obtain permission to do so. Chapter 4 covers the employment of women and young persons. Prohibits the employment of women during night hours (except in administrative or health-care jobs) and in hazardous or arduous working conditions. Forbids the employment of children (defined as persons under 12 years of age) and the employment of young persons (persons under 16 years of age) in specified tasks (s. 21). Hours of work for young persons shall be seven hours per day and one hour paid rest. Chapter 5 provides for employment contracts. Chapter 6 covers wages; wages shall be paid in cash, except for allowances for food, fuel, housing, transportation, and clothing, which may be paid in kind (s. 35). Chapter 7 regards matters related to hours of work and leave, including overtime, paid leave, and annual leave. Women workers shall be granted maternity leave of eight weeks (four weeks before and after confinement) for each year of service. Also provides for Hadj leave and Idda leave (mourning leave for a Moslem widow). Chapter 8 provides for matters regarding termination of employment and redundancy. Chapter 9 provides for severance pay, including for seasonal workers. Chapter 10 contains general provisions regarding penalties, validity of contracts with successor employers, and labour inspection. Establishes a National and District Council for Labour Relations. Chapter 11 regards occupational safety matters, including registration of factories, safety inspectors, notification of accidents, and the establishment of safety committees in factories employing 500 or more workers. Labour disputes are covered in Chapter 12. S. 101 provides that court cases related to persons planning an action in relation to a labour dispute shall be rejected, unless such actions were a "crime" as defined by law. Chapter 13 covers the settlement of labour disputes through negotiation and arbitration. S. 124 prohibits the partial or full stoppage of work. Final provisions are contained in Chapter 14. Repeals the Labour Force Act 1974, Industrial Relations Act 1976, Industrial Safety Act 1976, and the Individual Labour Relations Act 1981. Available in English. Also available in Arabic.

In 1989 all existing trade unions and associations were dissolved pending the promulgation of this Act, which adopts a new definition of "worker" that eliminates occupational distinctions, and gives each enterprise single union representation. The Minister of Justice is to issue regulations specifying the enterprises and sectors in which workers may establish trade unions. Workers who wish to form a trade union must form a preparatory committee on which all the constituents of the proposed union are represented. This committee is responsible for drawing up the constitution of the trade union. No sector or enterprise may be organised by more than one union, and the Registrar has the power to suspend the activities of any trade union committee if he considers that it is in breach of the law. The Act also provides for the formation of national trade union federations and national general professional associations, registration and dissolution of trade unions, and for transitional matters.

Prohibits further publication of the existing press until a new licence is issued by a competent body. Transfers so-called emergency powers, which are enumerated in this decree, to the chairman of the revolution council, applicable in conjunction with the state of emergency which has been declared throughout the Sudan. Any resistance against the provisions of this decree may be punished with imprisonment.
