This text is the consolidation of R.A. 6938. Defines cooperatives as an autonomous and duly registered association of persons, with a common bond of interest, who have voluntarily joined together to achieve their social, economic, and cultural needs and aspirations by making equitable contributions to the capital required, patronizing their products and services and accepting a fair share of the risks and benefits of the undertaking in accordance with universally accepted cooperative principles. This law defines the types of cooperatives, regulates their establishment including capital, membership, tax treatment and auditing and also provides for penal provisions in case of violation of the provisions of the Act.

These Regulations were issued by the Cooperative Development Authority, pursuant to the provisions of the Cooperative Code of the Philippines. They provide formats for the annual reports of cooperatives as well as filing dates and penalties for failure to comply (Rule 2). Rules 3, 4 and 5 relate to the value of shares in cooperatives and the voting rights of shareholders. Rule 6 deals with the method and effects of the merger or consolidation of cooperatives. Rules 7 and 8 relate to the division or liquidation of cooperatives, and Rule 9 to "laboratory cooperatives," i.e., cooperatives of minors.

An Act creating the Cooperative Development Authority to promote the viability and growth of cooperatives as instruments of equity, social justice and economic development, defining its powers, functions and responsibilities, rationalizing government policies and agencies with cooperative functions, supporting cooperative development, transferring the registration and regulation functions of existing government agencies on cooperatives as such and consolidating the same with the authority, appropriating funds therefor, and for other purposes.

The conditions for a proposed cooperative are that there should at least 15 qualified members and a paid-up capital of not less than P1,000.00. An operating and viable registered pre-cooperative which has complied with the minimum requirements of full-fledged cooperatives may be converted after verification by the Regional Director through an audit or inspection.
