Sec. 2. Declaration of Policies. – The State shall promote equal opportunities in employment for everyone. To this end, it shall be the policy of the State to:
(a) Promote employment of individuals on the basis of their abilities, knowledge, skills and qualifications rather than their age.
(b) Prohibit arbitrary age limitations in employment.
(c) Promote the right of all employees and workers, regardless of age, to be treated equally in terms of compensation, benefits, promotion, training and other employment opportunities.

Administrative Disciplinary Rules on Sexual Harassment Cases (CSC Resolution No. 01-0940, May 21, 2001). -

Applies to all officials and employees in government. Provides for the administrative offense of sexual harassment, which is defined as "an act, or a series of acts, involving any unwelcome sexual advance, request or demand for a sexual favor, or other verbal or physical behavior of a sexual nature, committed by a government employee or official in a work-related, training or education related environment of the person complained of" (Rule III). Sets out the procedures for making complaints, decisions and remedies.

Provides for benefits and privileges to single parents and their children. These include flexible work schedules, prohibition of work discrimination, parental leave, education benefits, housing benefits, and medical assistance. Also appropriates funds for this purpose.

Provides for the right of privacy for HIV infected persons and access to health care. The State shall promote public awareness, education and information with regard to HIV. Reestablishes the Philippine National AIDS Council (PNAC) which shall be attached to the Department of Health.

Anti-Sexual Harassment Act of 1995 (Republic Act No. 7877). -

S. 3 defines sexual harassment as a request for a sexual favor, accepted or not, from an employer, employee, manager, teacher, instructor, professor, coach, trainer or other persons who have "authority, influence or moral ascendancy" over another. Sexual harassment is committed when such a favor is demanded in return for employment or promotion, or refusal to grant such a favor results in the impairment of an employee's rights, privileges, or employment opportunities. S. 4 requires employers to establish sexual harassment rules and procedures for the investigation of sexual harassment cases. These rules shall not bar prosecution in proper courts.

The Social Security Commission, which directs and controls the Social Security System, shall be composed of the Secretary of Labor and Employment, the Social Security System Administrator, and seven appointee members. Three of these appointees shall represent workers and three shall represent employers; one of the worker representatives and one of the employer representatives must be a woman. A seventh appointee shall represent the general public.

The intent of the Act is to promote the integration of women as full and equal partners with men in development and nation building. The National Economic and Development Authority is given primary responsibility for carrying out the purposes of the Act. The Act grants women, regardless of their marital status, full legal capacity to act and to enter into contracts. It grants them equal access to membership in all social, civic and recreational clubs as well as the right of admission into military schools. Full-time homemakers shall have the right to participate in government-sponsored social security schemes.

This Act amends s.135 of the Labor Code (LS 1974-Phi. 1A) to strengthen the prohibition of discrimination against women with respect to terms and conditions of employment. It defines discrimination as paying lesser compensation to a woman for work of equal value and favouring a male employee on account of sex with respect to promotion, training opportunities, study and scholarship grants. In addition to penalties provided under the Code, the aggrieved employee may file a claim for money damages and affirmative relief.
