    Establishes the Committee on Protection of Income of Government Employees. Its purpose is to formulate, implement and monitor programs and projects to provide assistance to civil servants, particularly those in financial difficulties. Measures are to include ensuring that other government agencies and government owned and/or controlled corporations: adopt the poverty threshold as the limit for the imposition of wage deductions; eradicate the debt-culture; promote workers morale and welfare; and motivate officials and workers to respect the public service ethical standards.

    Provides that no officer or employee in the career service shall be removed except for a valid cause and after due notice and hearing. Sets out the order in which employment of civil servants is to be terminated based on length of employment and status of contracts. Employees can appeal decisions in the first instance to the appointing authority and then to the Civil Services Commission.

    In addition to increasing the minimum wage, contains provisions regarding the resolution of disputes in relation to wage structure distortion. Workers paid by result or on a piecework basis shall receive not less than the applicable statutory minimum wage for eight hours' work (or proportion thereof for fewer hours). Learners, apprentices and handicapped workers are entitled to 75 percent of the minimum wage. Provides for exceptions and penalties. Repeals inconsistent legal provisions.

    This Executive Order provides that all government employees can form, join or assist employees' organisations of their own choosing for the furtherance and protection of their interests (s. 2). This applies as well to labour-management committees, works councils and other such participation schemes. The Order contains protections of the right to organise (ss. 5-6), governs the registration of employees' organisations (ss. 7-8) and addresses appropriate organisational units (ss. 9-12). It further refers to negotiations (s. 13), strikes (s. 14) and the settlement of disputes (s. 16). The Order also establishes the Public Sector Labor-Management Council (s. 15).

    Amends s. 1 of the Act to provide for punishment by imprisonment of any public officer or employee who obstructs, prohibits or otherwise prevents an attorney from conferring with a person who has been arrested, when that conference has been requested by the detainee or by a national or international non-governmental organisation duly accredited by the Office of the President.

    These amendments primarily address trade union representation and procedures governing the right to strike. The Order also amends ss. 60 and 61 regarding the employment of apprentices and the contents of apprenticeship agreements, as well as s. 128(b) regarding powers to order compliance with labour standards. The Order replaces the provisions on state policy towards the labour movement (s. 211(c) of the Labor Code (LS 1974 - Phi. 1A (published as s. 210(c))) and changes one of the registration requirements for labour organizations (s. 234(c) (published as s. 233(c))). It amends s. 245 on the right of employees in the public service to organize and bargain collectively and ss. 257 and 258 on representation issues in organized establishments and petitions in unorganized establishments. Sections numbered in the Order as s. 264(c) and (f) and s. 265(d) address the filing of a notice of a strike or lockout and cooling-off periods, the requirements for a decision to declare a strike or lockout, and the prohibition placed on public officials to introduce or escort replacements for strikers. The provisions of ss. 238 and the second paragraph of ss. 239 and 241 (published as ss. 237, 238 and 240) on the structuring of the labour movement are repealed, as is Letter of Instruction No. 1458 to the extent indicated in the Order. The Order becomes effective 15 days after publication in the Official Gazette.

    This Order calls upon every government ministry and instrumentality to adopt rules and procedures for the review and assessment of its personnel and to complete its review no later than 24 Feb. 1987. On the basis of this process, officials and employees may be separated from service by reason of the grounds set forth in s. 3 of the Order (corruption, gross incompetence, etc.). The Order also creates a Committee to act on all petitions for reconsideration of dismissal; its decisions are final.

    Makes it punishable for any public official or employee, whether of the national or local governments, to receive, directly or indirectly, and for private persons to give, or offer to give, any gift, present or other valuable thing to any occasion, including Christmas, when such gift, present or other valuable thing is given by reason of his official position, regardless of whether or not the same is for past favor or favors or the giver hopes or expects to receive a favor or better treatment in the future from the public official or employee concerned in the discharge of his official functions. Included within the prohibition is the throwing of parties or entertainments in honor of the official or employees or his immediate relatives.
