    The purposes of this Act are:
    (a) to facilitate the settlement of civil proceedings between certain parties about the payment of wages at the minimum rate prescribed under the Minimum Wage Act 1983 to employees who are allowed by their employer to sleep overnight at their workplace while on duty; and
    (b) to provide for a staged progression towards full compliance with the Minimum Wage Act 1983 in respect of the wages payable to certain employees who perform sleepovers; and
    (c) to provide a mechanism for extending the application of subparts 1 and 2 of Part 2 to other employers that are funded through a Vote and to those employers' employees to enable, among other things, disputes that involve the same, or substantially the same, issue as that described in paragraph (a) to be settled.

    (2) To those ends, this Act:
    (a) gives legal effect to certain aspects of the terms of the settlement of the parties referred to in subsection (1)(a); and
    (b) extinguishes certain claims for sleepover wages in respect of sleepovers performed before the commencement of this Act; and
    (c) creates entitlements to back wages for certain sleepovers; and
    (d) provides for a staged progression of payments for sleepovers towards the minimum hourly rate prescribed under the Minimum Wage Act 1983; and
    (e) provides an Order in Council mechanism for extending the application of subparts 1 and 2 of Part 2 to other employers that are funded through a Vote and to those employers' employees; and
    (f) preserves the agreement dated 13 September 2011 between the Crown, Idea Services Limited, Phillip William Dickson, and the Service and Food Workers Union Nga Ringa Tota as it relates to the decision of the Court of Appeal in Idea Services Limited v Phillip William Dickson [2011] NZCA 14.

    Establishes that the Minimum Wage Act 1983 shall not apply if (a) the employee is required by his or her contract of service to undertake at least 60 credits a year of an industry training programme, for the purposes of becoming qualified for the occupation to which the contract of service relates; and (b) the industry training programme is registered in the National Qualifications Framework as provided for by the Education Act 1989.

    Amends sections 34 and 35 of the Child Support Act 1991 relating to circumstances in which custody of 2 or more children is split between 2 liable parents. Inserts a new Part VIA relating to departure from formula assessment of child support. Also provision on unremitted deductions made by employers.

    In the Labour Relations Act 1987 (LS 1987 - NZ 1), amends inter alia, ss. 2 (definitions), 121(1) (Tripartite Wage Conference), 196A (restriction on right of entry for enforcement purposes), 207(1) (power to order compliance), 280(1) (Labour Court jurisdiction), various sections in relation to extension of awards, and the Eighth Schedule regarding essential services.

    Amends the Minimum Wage Act 1983 (ss. 2, 5, 8(1), 10 and 11). In particular, new s. 5 requires the Minister of Labour to review each year any minimum rate prescribed pursuant to s. 4 of the Act. Adds new ss. 8A, 8B, 8C and 8D on wages and time records and the right of inspectors to enter for enforcement purposes, and new s. 11A on compliance orders.

    Contains amendments to the Fire Service Act 1975 and the State Services Conditions of Employment Act 1977 occasioned by the enactment of the Labour Relations Act 1987 (LS 1987 - NZ 1). The amendments deal in particular with union elections, membership clauses and jurisdiction of the Labour Court.

    Part I of the Act contains a statement of principles, including the operation as a successful business as being the main objective of every State enterprise. To this end, it shall be "(a) as profitable and efficient as comparable businesses that are not owned by the Crown; and (b) a good employer; and (c) an organisation that exhibits a sense of social responsibility..." (s. 4(1)). A "good employer" is defined as an employer whose personnel policy ensures the fair and proper treatment of employees, including good and safe working conditions, an equal opportunities employment programme, the impartial selection of suitably qualified persons for employment, and opportunities for the enhancement of the abilities of individual employees (s. 4(2)). Part II of the Act embraces provisions on the formation and ownership of new state enterprises. Part III governs accountability and Part IV contains miscellaneous provisions. The Act includes six Schedules covering, inter alia, repeals of other enactments and a list of state enterprises.

    Union Representatives Education Leave Act 1986. No. 35 [LS 1986 - NZ 1].

    This Act provides for authorised union representatives to be granted leave with pay by their employers in order to attend approved union education courses. Part I governs entitlements to leave, administrative arrangements and the granting of leave. The Act guarantees continuity of employment and of contributions to superannuation schemes for workers taking education leave (ss. 26 and 27). It also protects against use of undue influence (s. 29) and dismissal while on leave (s. 31). Part II of the Act establishes the Trade Union Education Authority whose functions include promoting and co-ordinating union education, approving courses, producing teaching materials, making recommendations to the Government, and co-operating, where appropriate, with the ILO and other international authorities and union organisations. Under s. 69 of the Act, the Trade Union Training Board established under the Vocational Training Council Act 1968 (LS 1968 - NZ 1) is dissolved. (Note: this Act was amended by the Labour Relations Act 1987 (No. 77).)

(Note: this 1985 Amendment Act was repealed by the Labour Relations Act 1987 (No. 77).
