    The aim of these amendments is to provide for job guarantees for employees who must undergo prolonged medical examinations and tests and who, for similar reasons, may not be able to work for a period of time. This includes protection from dismissal in cases of medical problems.

    Amends the Work Time Decree ("Arbeidstijdenbesluit") of 1995 (Stb. No.599). The text of the present decree provides amendments in many sectors of paid employment as well as voluntary work and concerns work time and rest time regulations. The purpose of these amendments is to provide for updated regulations that are in line with new types of jobs and the demands in industry in the private and public sectors. (Related to this Decree is also the Stb. No.422 of 22 September 1997 which concerns work and rest time for railway employees.)

    Decree of 5 July 1997 amending the Instruction Decree Obligatory Insured Sickness Fund Act in connection with the Obligatory Sickness Fund Insurance of persons who take full-time parental leave.

    The Instructions Decree Obligatory Insured Sickness Fund Act (Stb. No.66, 1996) is herewith amended to provide for more flexibility when employees choose full-time and long-term parental leave with or without pay. The flexibility is necessary to provide for a continuation of the Sickness Fund Insurance which would otherwise expire after a period of leave from paid work. This decree provides that the Sickness Insurance will remain valid while a worker takes unpaid parental leave and its costs will be recovered through special administrative procedures as long as the parental leave does not exceed 26 weeks. See also Stb. No. 266 of 25 June 1997 which concerns parental leave.

    Act of 25 June 1997 amending the Workers Agreement in the Civil Code regarding parental leave.

    This Act amends section 7.10 on parental leave in the Workers Agreement ("arbeidsovereenkomst") of the Civil Code ("Burgerlijk Wetboek"). A new definition of eligibility is provided for employees who are parents or legal guardians of a child. Futhermore, the time frame for eligibility is also redefined as well as the amount of time for which parental leave is given.

    Decree of 28 May 1997 amending the Work Time Decree.

    The Work Time Act (see also Stb.126, 1997) and the Work Time Decree were entered into force on 1 January 1996. They replace the Labour Act of 1919 and all decrees based on it. With this change, all labour organizations in the Netherlands have been placed within the Work and Rest Time framework ("kader van arbeids- en rusttijden"). The purpose of the above decree is to harmonize the administrative changes with different sectors of economic activity and employment.

    Employer and employee are prohibited from terminating a labour relationship without the authorization of the Minister of social affairs and employment. This prohibition applies to termination of work relations by advance notice only. It shall also be forbidden for the employer to reduce the working time of the employee to less than 48 hours a week, providing this would entail a wage reduction.

Allows night work and longer working hours for certain professions, including those in shipping and air transportation. Extends allowed overtime hours up to 72 hours per week, calculated for a period of four weeks. Also provides for the compensation of overtime work through free time.
