    Regulation 1. Citation and commencement.
    These Regulations may be cited as the Occupational Safety and Health (Employers' Safety and Health General Policy Statements) (Exception) Regulations 1995 and shall be deemed to have come into force on the 25th February 1994.

    Regulation 2. Exceptions.
    Section 16 of the Act shall apply to every employer and every self-employed person except those who carry on an undertaking with not more than five employees.

    Comprehensive legislation governing occupational safety and health. Part III establishes a National Council for Occupational Safety and Health. Part IV requires employers and self-employed persons to ensure safety at the workplace; Part V requires manufacturers of plant used in workplaces to test such machinery for safety hazards. Part VI sets forth duties of employees. Inter alia, employees must use protective equipment when appropriate. Employees shall not be dismissed or otherwise injured for making a complaint about a safety or health matter. Part VII provides for medical surveillance in industries involving special risks to health, defined in Schedule 3. Also requires the creation of safety and health committees in enterprises with over 40 employees. Reporting of accidents and occupational diseases is covered in Part VIII. Parts IX-XV cover prohibitions against the use of certain plant or substances, industry codes of practice, and enforcement, investigation, liability and sanctions in relation to the Act.
