Inter alia, casual employees employed for more than 90 days in one year shall be confirmed to regular monthly terms of employment (s. 4); employees shall be entitled to a housing allowance if the employer does not provide free housing (s. 6).

    Provides for determination of effective date of appointment to a particular post, and assessment of salary on promotion of an officer to a higher grade. Also sets out criteria for granting of annual increments including incremental credits for previous approved experience relevant to the type of work upon which an officer is engaged, and determination of relative seniority of officers. First part deals with date of initial payment of salary on appointment, date of commencement of new scale of salary, salary of an officer taken ill before assuming duties of appointment, salary of an officer detained outside Kenya on public grounds, determination of salary on promotion of a serving officer from one job group to another, and determination of salary of an officer transferred from another administration of local authority. Second part regulates definition of increment, determination of incremental dates on appointment or promotion, conditions for granting of increments, method of payment of increments, definition of increments withheld or stopped, procedure for withholding or stoppage of increments, service for increments, and increments for approved experience. Finally, Part III provides for determination of seniority among officers.

Makes provision for job groups applicable in the Public Service, categories of appointment, powers of appointment and procedures to be followed, reporting of vacancies, overseas recruitment, form of application, record of previous employment and qualifications, medical examination of candidates, general conditions of employment, letters of appointment, date of appointment, employment of pensioners, employment of non-Kenya citizens, appointment on probation to the pensionable establishment, age of admission to pensionable establishment, confirmation in appointment and admission to pensionable establishment, procedure of confirmation in appointment, appointment on agreement terms, appointment on temporary terms, address of an officer's next-of-kin, certificate of service, certificate of long service for members of subordinate service, testimonials and commendatory letters, schemes of service, promotions, dates of promotion, release of officers selected for promotion in other ministries, transfer of officers from one ministry or department to another, transfers to and from the public service of Kenya, secondment of officers to statutory boards or similar organisations, and subordinate service.

    This Order deletes the First Schedule of the Regulation of Wages (Agricultural Industry) Order 1982 and inserts a new Schedule which provides for the basic minimum consolidated daily and monthly wage rates for certain classes of unskilled, skilled and semi-skilled employees.

    Regulation of Wages (Building and Construction Industry) Order 1989. L.N. No. 11.

    This Order, which applies to employees in the industries of construction, structural alteration, maintenance or repair of any building, construction of any railways line, demolition etc., establishes basic minimum wage rates. Sections 5-9 relate to hours of work, overtime pay, holidays with pay, annual leave and leave travelling allowance. Maternity leave is provided by s.13 (twelve weeks, eight of which are paid). Section 15 covers retirement benefits and terminal benefits. Workers' compensation is provided for in s.28. Revokes the 1980 Order of the same name.

    Order issued pursuant to the Regulation of Wages and Conditions of Employment Act, Chapter 229. Applies to persons employed directly or indirectly by an undertaking involved in 1) private investigation or security consultancy, 2) guarding of industrial plants, banks, warehouses, etc. against theft, illegal entry or fire and 3) escort of money or other valuable property. Order stipulates the applicable minimum wage and regulates housing allowances, work hours, overtime provisions, sick and maternity leave, death expenses and bereavement expenses.

    Amends the Regulation of Wages (Agricultural Industry) Order 1982 under the Regulations of Wages and Conditons of Employment Act (Cap. 229). Substitutes a new First Schedule establishing basic minimum consolidated wages for various categories of unskilled, skilled and semi-skilled employees.

    Factories (Building Operations and Works of Engineering Construction) Rules 1978. L.N. No. 179.

    The Factories Act (the basic text) has since been repealed by article 129 of the Occupational Safety and Health Act, 2007 (Act No. 15 of 2007), which becomes the new basic text for this Regulation. Article 129(2)(b) provides that:

    "any subsidiary legislation issued before the commencement of this Act shall, as long as it is not inconsistent with this Act remain in force until repealed or revoked by subsidiary legislation under the provisions of this Act and shall, for all purposes be deemed to have been made under this Act."
