Chemicals Act 2008 (No. 13 of 2008). - Adoption: 2008-07-15 | IRL-2008-L-85924 An act to regulate and control the manufacture, use, placing on the market, export, import, transport, testing, storage, classification, labelling and packaging of chemicals; to make provision in relation to major accident hazards, and the prevention of accidents, involving chemicals; for those purposes to give further effect to Regulation (EC) No. 304/2003 of the European parliament and of the Council of 28 January 2003 concerning the export and import of dangerous chemicals , Regulation (EC) No. 648/2004 of the European parliament and of the Council of 31 march 2004 on detergents and Regulation (EC) No. 1907/2006 of the European parliament and of the Council of 18 December 2006 concerning the registration, evaluation, authorisation and restriction of chemicals (reach) and establishing a European chemicals agency ; to confer power on the minister for enterprise, trade and employment to make regulations for the purpose of giving effect to certain provisions of the treaties governing the European communities and certain acts of the institutions of those communities; and to provide for matters connected therewith.
Amends the Safety, Health and Welfare at Work Act 2005, section 34(1), by inserting after paragraph (d) the following:"(dd) to perform the functions conferred on the Authority by the Chemicals Act 2008," and in Schedule 6, paragraph 5, by substituting "paragraph 4" for "paragraph 3".

No. 078 of 2001). - Adoption: 2001-03-08 | IRL-2001-R-58972 Provides for obligation of employers to carry out an assessment of the risks associated with the use of carcinogens or mutagens in the workplace, and the taking of subsequent steps to control such risks by eliminating or minimising exposure. Employers must also ensure that employees who are at a possible risk of exposure to such substances be consulted and provided with information and training on the nature of the hazards and risks of carcinogens and mutagens. Finally, makes provision for obligation of employers to maintain records on the results of assessments, measurements of exposure and health surveillance. Such records must be available to the National Authority for Occupational Safety and Health.

The main changes introduced in this order are inclusion of work activities involving exposure to natural sources of radiation; stricter application of existing radiation protection principles through the introduction of lower dose limits, the use of dose constraints in keeping doses as low as reasonably achievable and extended application of justification principles; and the introduction of radiation protection principles for intervention in cases of radiological emergencies or lasting exposures.

Places an obligation on clients and designers to ensure health and safety is taken into account before any construction work begins. Contractors shall ensure that the work on site is properly coordinated and carried out in a safe manner. Revokes Construction (Safety, Health and Welfare) Regulations 1975.

Safety, Health and Welfare at Work (Signs) Regulations, 1995 (S.I. No. 132 of 1995) Adoption: 1995-05-29 | Date of entry into force: 1995-06-01 | IRL-1995-R-41408 Implements Council Directive 92/58/EEC on the minimum requirements for the provision of health and safety at work. In contrast with the European Communities (Safety Signs at Places of Work) Regulations 1980 (which are now revoked and which only required that if and when safety signs were used at work they should conform to specified standards) these Regulations require employers to use a safety sign wherever there is a risk that cannot be adequately controlled by other means. The provisions of the Regulations extend to all places and they relate to signs referring to a specific object, activity or situation which provide information or instructions about safety and/or health at work by means of a signboard, a colour, an illuminated sign, an acoustic signal, a verbal communication or a hand signal. Made under the Safety, Health and Welfare at Work Act, 1989.

No. 80 of 1993) Adoption: 1993-03-26 | Date of entry into force: 1993-03-31 | IRL-1993-R-34141 Gives effect to Council Directive 90/394/EEC of 28 June, 1990 on the protection of workers from risks related to exposure to carcinogens at work. Under the Regulations an employer must carry out an assessment of the risks associated with the use of carcinogens in the workplace, and take steps to control such risks by eliminating or minimising exposure. Employers must assure that employees who are at possible risk of exposure to carcinogens are consulted and provided with information and training on the nature of the hazards and risks of carcinogens. Employees must also be provided with the facility to undergo health surveillance if desired.

European Committees (Major Accident Hazards of Certain Industrial Activities) (Amendment) Regulations, 1989. S.I. No. 194. Adoption: 1989-07-28 | IRL-1989-R-8629 The purpose of these Regulations is to implement Council Directive 87/216/EEC on the major accident hazards of certain industrial activities. These Regulations amend the definition of industrial processes and adjust the thresholds whereby certain substances attract notification requirements. The definition of activities deemed to be particularly dangerous is amended to cover industrial processes and storage involving sulphur trioxide and industrial processes involving liquid oxygen.

The Regulations provide for revised safety requirements in certain circumstances for petrol filling stations, constructed before the 1979 Regulations commenced, to enable them to operate until 1999-12-31. Safety controls are retained.

Safety, Health and Welfare (Offshore Installations) Act 1987. No. 18. Adoption: 1987-07-22 | IRL-1987-L-3824 An Act to provide for the safety, health and welfare of persons on installations concerned with the exploration for or exploitation of petroleum or other minerals in the waters in or surrounding the State, and generally for the safety of such installations and the prevention of accidents on or near them. The Act delineates responsibilities in terms of maintaining safety and discipline on such installations and outlines the general duties of persons employed thereon. It prohibits the employment of persons under the age of 18 and persons who have not received adequate instruction or training (s. 14). The Act provides for the selection of a safety representative, safety committee and safety delegate and sets forth various recordkeeping and reporting requirements. It also calls for inspection and penalties in case of infringement, and prohibits certain deductions from wages (s. 46).
