Makes provision for the transition from the arrangements for the Scheme set out in the Local Government Superannuation (Scotland) Regulations 1987 to those set out in the 1998 Regulations. Revokes provisions of the 1987 Regulations relating to administration of the Scheme for all members of the Scheme and disapply the other provisions of the 1987 Regulations for those who are members in employment on that date. Also provides for the continuation of most provisions of the 1987 Regulations for members who are not then active members and for the corresponding provisions of the 1998 Regulations not to apply to them.

    Replaces the provisions of the Local Government Superannuation (Scotland) Regulations 1987 (S.I. 1987/1850) and constitute the occupational pension scheme for persons engaged in local government employment in Scotland (other than teachers, policemen and firemen) who are active members of the Scheme on or after 1 April 1998. Also replaces them in part for other members in accordance with the Local Government Pension Scheme (Transitional Provisions) (Scotland) Regulations 1998 (S.I. 1998/364). Except as so replaced the 1987 Regulations will continue to apply to deferred or pensioner members unless they become active again.

    Amends the Council Tax Benefit (General) Regulations 1992 (S.I. 1992/1814), the Disability Working Allowance (General) Regulations 1987 (S.I. 1987/2887), the Family Credit (General) Regulations 1987 (S.I. 1987/1973) and the Housing Benefit (General) Regulations 1987 (S.I. 1987/1971) so that the maximum deduction for relevant child care charges in respect of a claimant's family shall be 60 pounds per week when charges are paid in respect of one child only, or 100 pounds per week when charges are paid for more than one child.

    Provides that, except in circumstances prescribed by regulations made under the Pensions Schemes (Northern Ireland) Act, 1993, a surviving spouse shall be entitled to a pension on the death of a member of a judicial pension scheme providing the marriage took place before the member retired. Also amends the Judicial Pensions (Guaranteed Minimum Pension) Order (Northern Ireland) 1995 in order to clarify the calculation of the contribution to a surviving spouse's guaranteed minimum pension payable in the event of marriage during retirement.

It replaces the existing provisions whereby such an appeal is determined by a single medical referee with provisions providing for determination by a board consisting of three medical referees. Makes fresh provision on the submission of written evidence relating to an appeal and amends provisions on costs.

Amends the Social Security (Incapacity for Work) (General) Regulations (Northern Ireland) 1995 so that certain persons who are entitled to disablement pension, or assessed for the purpose of severe disablement allowance as 80 per cent disabled, are treated as incapable of work.

Establishes the requirements which apply to policies of insurance and annuity contracts for the purposes of discharging liability. Prescribes the further conditions on which policies of insurance and annuity contracts may be assigned, surrendered or commuted and on which liability may be discharged.

Establishes the type of transfer credits which may be included in a charge or lien on, or set-off in respect of a monetary obligation due to an employer. Establishes the circumstances where a pension may not be charged for the purpose of discharging some monetary obligation to the scheme. Establishes the circumstances in which a pension under an occupational pension scheme can be forfeited. Provides for certain schemes to be exempt from the inalienability and forfeiture provisions.
