2007 National Policy on Sexual Harassment in the Workplace. - Adoption: 2007 | FJI-2007-M-77673 Provides for rationale for the policy, definition of sexual harassment, employers' responsibilities, workers' responsibilities, complainants statutory rights under: the Human Rights Act 1999; section 154 of the Penal Code; and the personal grievance procedure under the Employment Relations Promulgation 2007. Every workplace must establish a Sexual Harassment Monitoring and Evaluation System.

Social Justice Act 2001 (Act No. 5 of 2001). - Adoption: 2001-12-24 | FJI-2001-L-70279 The Act implements the social justice provisions set out in the Constitution (Chapter 5) by establishing programs of affirmative action. The Schedule lists affirmative action programmes in place which are delcared as complying with section 44 of the Constitution.

Rehabilitation of Offenders (Irrelevant Convictions) Act, 1997 (No. 11 of 1997). Adoption: 1997-06-11 | FJI-1997-L-47002 Prohibits discrimination regarding employment, membership, or access to facilities on the part of employers, trade unions, vocational training bodies and other public institutions on the basis of an "irrelevant conviction." An irrelevant conviction is defined as a conviction for a criminal offence which has no direct bearing on the matter at hand, or if a rehabilitation period has expired. For person over 17 years of age, the rehabilitation period shall be 10 years after conviction or completion of penal sentence; for persons under 17, the period shall be between 7 and 10 years. Also prohibits unlawful disclosure of information regarding irrelevant convictions.

Protection of Fundamental Rights and Freedoms of the Individual Decree. No. 12. Adoption: 1988-01-29 | FJI-1988-R-4657 Sets forth rights to which every person in Fiji is entitled, "whatever his race, place of origin, political opinions, colour, religion, creed or sex, but subject to respect for the rights and freedoms of others and for the public interest..." (s. 2). Protections include: right to life; personal liberty; protection of freedoms of expression (s. 11), assembly and association (s. 12); and protections from slavery and forced labour (s. 5), inhuman treatment (s. 6) and discrimination (s. 14), inter alia. Repeals provisions of the Fundamental Freedoms Decree (No. 12) and the Fundamental Freedoms (Amendment) (No. 1) Decree (No. 13), to the extent that they are inconsistent with this Decree. Deemed to have entered into force on 5 Dec. 1987.
