    Introduces 9 articles - based on the Act (No. 32 of 1976) respecting equal wages for men and women - concerning, inter alia, the obligation to provide equal pay to men and women; the obligation of public authorities to develop acts, policies, activities etc. that actively promote non-discrimination; the obligation of employers with more than 35 employees to develop gender-based statistics; legal procedure for complaining about gender-based discrimination; and the integration of the EU Directive on equal opportunity and equal treatment of men and women.

    Adds new ss. 5(2), 5a(5) (prohibition of discrimination does not prevent special rules regarding wages for young persons below 18 years to be regulated in collective agreement); and 5a(6) (prohibition of discrimination based on age is not applicable to young persons under 15 years, unless the employment is regulated by collective agreement).

    Act (No. 286 of 1996) respecting the use of health information in the labour market.

    Introduces (s.1) a general prohibition against unjustified use of information on the status of health of an employee for the purpose of limiting the employee's possibility to obtain or maintain an employment. Sets out the conditions for the employer to request and require information (ss. 2-5), and the extent of the employee's obligation to provide information (ss. 6-7). Sets up (s. 8) a council competent to provide advice on issues referred for decision pursuant to the Act. Regulates (s. 9) how consent by the employee is to be provided, (s. 10) the required competence of examining personnel, and (s. 11) applicable non-disclosure rules. Ss. 12-14 provide for compensation and fines for violations of the Act.

  16. Denmark - Non-discrimination - Law, Act

    Notification of the Act respecting equal wages for men and women (No. 639 of 1992).

    Provides for equal remuneration for equal work for men and women. An employer may not dismiss a worker because the worker demands equal pay. Any agreement contrary to this Act is null and void.
