Government Decree No. 409/2011 on increasing the living minimum and subsistence minimum levels. (NARÍZENÍ VLÁDY ze dne 7. prosince 2011 o zvýšení cástek životního minima a existencního minima) -

The minimum subsistance level of an individual is fixed to 3410CZK per month.
The minimum subsistance level of one person is 3140CZK per month. For dependents or other persons living in the same family, the minimum subsistance level is:
a) 2830CZK for a person older than 15 years and who is not a dependant child;
b) 2450CZK for a dependant child between 15 and 26 years of age;
c) 2140CZK for a dependant child obetween 6 and 15 years of age; and
d) 1740CZK for a dependant child under 6 years old.

The living minimum of a person is set at 2200CZK per month.

- completely replaces Sections 1 and 2, concerning the evaluation of the capacities of the person to perform basic tasks of everyday life;

- amends Annexes 1, 2 and repeals Annex 3.

Amends numerous sections of the Act No. 111/2006 on providing help in material distress. Repeals sections 12, 17, 30, 32; adds 35a; repeals 41, 66. The amendments concern in the first part pregnant and breast-feeding mothers. Some provisions also touch the topic of reimbursement of benefits received that exceed the entitlement of the person.

Amends numerous sections of the Act No. 108/2006 on social services. The amendments inter alia concern the classification of dependent persons and the degree of dependency. They also regulate the rights and obligations of different types of public servants towards the dependent person (i.e. access to the home of such person).

Amends following sections of the Act No. 117/1995 on Social Assistance: 2a, 3, 19(2); adds 27a; amends 30, 30a, 30b, 31; repeals 32; amends 37(3), 47, 50; adds 54a; amends 58(3), 59(7), 61(3), 62 - 64, 64a, 65(4), 65c(6), 68 - 69, 70(3), 71(1); repeals 73 and 73b; amends 73a. The amendments concern the conditions of eligibility for parental benefits as well as its withdrawal due to a negligence of the child. It also modifies provisions concerning the eligibility and duration of housing subsidies.
