    Cyprus ratified the Protocol the 9th of October 2006. As a consequence, this law also amends article 2 of the law 13(III) of 1995.

Includes provisions on safety management and the power of the Minister to impose conditions on ships registering in Cyprus for the safety of human life on board (Articles 5 and 14B). Also gives the Minister the power to take a ship of the registrar if they violate certain conditions including those concerning the working and living conditions of the seamen who are working on board (Article 6).

    Amends and supplements earlier legislation by redifing the term "certificate of competence" and by introducing provisions as regards the common language or working language on board ship, port State control procedures and the competence certification of those responsible for the safety on board ship and the prevention of pollution.

    Supplements Law No. 106(I) of 2000 by extending co-operation between the competent authority and any EU member State or other Party to the STCW Convention, which is advised of the Cyprus Government's intention to initiate judicial proceedings under the jurisdiction of the former for cases of non-compliance with sections 21 and 22 of the Law.

    Makes provisions regarding the certification of seafarers, including the format of endorsement, the recognition and revalidation of certificates and the responsibility of Member States as regards training and assessment of seafarers. Stipulates the obligation of Member States to submit to the European Commission reports concerning the evaluation of quality standards applicable to the administration of the certification system and to share information concerning certificates, endorsements and dispensations with other Member States or Parties to the STCW Convention and companies requesting verification of the authenticity and validity of certificates.

Makes provision for the inspection of ships and introduces enforcement measures providing for penalties against ships violating the provisions of the Law.

Also establishes the acts and omissions which are considered as disciplinary offences, makes provisions for the creation and composition of the Merchant Marine's Disciplinary Council and allows for the temporary or a definite removal of a seafarer's professional identity card, the suspension of its force and/or the annulment of certificates of professional competency.

    Act No 105(I) of 2000 to regulate matters concerning the safe manning of the ships, the working and resting hours of the seafarers, the maintenance of watch-keeping and the composition of the crew.

    Defines, inter alia, obligations for companies relating to seafarers' certificates and documents, maintenance of registers, on the job training for seafarers, capitain's duties relating to security rules, efficient co-ordination in the event of emergencies, and familiarisation with survival techniques. Also provides dispositions concerning working and resting hours for seafarers, watch-keeping systems, the composition of Cypriot ships as regards organic posts, and the inspection and control of foreign ships. The seventh and concluding part provides dispositions concerning the inspection of outbound ships and their detention in case of problems of compliance.

Provides for the recognition of foreign states' certificates, which are part of the STCW Convention, defines minimum levels of professional training and provides for the recognition of professional schools.

    Amends provisions (sec. 3 and 4 of the basic Act) concerning the professional qualifications of the ships officers and the seafarers in the merchant marine. Prescribes that all ships officers or seafarers must be holders of the "certificate of specialised training" corresponding to their grade.

    The Act amends the 1963-1982 legislation on this subject. The amendment is introduced in s. 23 of the Act. The new provisions, which bear the numbers 23A to 23H, permit the double registration of vessels (vessels registered abroad may be registered in Cyprus).
