    Article 2 provides for the interpretation of the term “Protocol” in the context of the present Law, as the Protocol to the Forced Labour Convention, 1930 (Convention N° 29) of the International Labour Organization, approved in the 103rd Session of the General Conference on 28 May 2014, the accession to which has been approved by the Ministerial Council under its Decision N° 79.561, dated 07.10.2015.

    Article 3 provides for the ratification of the Protocol.

    Article 4 sets forth the issuance of Regulations by the Ministerial Council in view of better implementing the provisions of the present Law and of the Protocol, which may provide for criminal offences in case of breach and for sanctions against the commitment thereof.

    The Law includes an Index to article 3, which in its PART I, provides for the original text of the Protocol in English, whereas in its PART II for the translated text in Greek.

    The present Law, under its article 2, amends article 3 of the basic Law on Maternity Protection (Laws of 1997 to 2015), by amending the phrasing of phrases 3A, 5 and 5A, in order to extend the regulations and the maternity leave provided for therein, in case of more than one child born out of the same labor.

    The present Law regulates issues regarding the Candidates Evaluation for Recruitment in the Public Service (Temporary Provisions), in view of:
    - the suspension of filling of first recruitment vacancies, of first recruitment and promotion vacancies and of promotion vacancies for 2016 (01.01.2016-31.12.2016), pursuant to the article 17 of the Law of 2015 on the Budget of 2016;
    - the fact that similar regulations may be included in the State Budget of 2017 (01.01.2017-31.12.2017) because of the need for confining the public expenditure;
    - the fact that the aforementioned article provides for the possibility to exempt from the suspension of filling of vacancies those that are necessary to be filled following the proposal of the competent authority;
    - the fact that it is considered necessary to regulate on a temporary basis the process of filling of vacancies in the Public Service, for which vacancies the provisions of the Law on Public Service apply and which fall within the scope of application of the Law on the Candidate's Evaluation for Recruitment in the Public Service, in case those vacancies are to be exempted from the suspension of filling.

    Article 2 provides for the definition of the following terms: “written examination”, “position”, “Law” and “Examinations Service”.

    Article 3 introduces special provisions for the suspension of application of several provisions of the Law and for the temporary insertion of other provisions for the filling of vacancies that are to be exempted from the suspension of filling.

    In view of:
    - Harmonizing Cypriot legislation with the Directive 2013/33/EU of the European Parliament and of the Council of 26 June 2013 laying down standards for the reception of applicants for international protection, as amended, with the exception of articles 9(6)-(10) and 26 thereof;
    - Harmonizing Cypriot legislation with the articles 2(d), (e), (n), (q), 9(1), 12(2), 13(2)c, 24(1) and (2), 29(1), 33(1) and (2), 38(2), 45(3) and 52 of the Directive 2013/32/EU of the European Parliament and of the Council of 26 June 2013 on common procedures for granting and withdrawing international protection, as amended;
    - Better harmonizing Cypriot legislation with he articles 14(1) and (4), 17(1) and 19(1) of the Directive 2011/95/EU of the European Parliament and of the Council of 13 December 2011 on standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees or for persons eligible for subsidiary protection, and for the content of the protection granted;
    - Re-harmonizing Cypriot legislation with the articles 4(1), 10(1), 7(3) and 22 of the aforementioned Directive 2011/95/EU;
    - Re-harmonising Cypriot legislation with the article 18 of the Council Directive 2001/55/EC of 20 July 2001 on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and on measures promoting a balance of efforts between Member States in receiving such persons and bearing the consequences thereof;
    - Re-harmonizing Cypriot legislation with the article 11 of the Council Directive 2003/86/EC of 22 September 2003 on the right to family reunification;
    - Effectively implementing the article 27, para 3, element (a) of the Regulation (EU) N° 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person;
    - Better implementing the basic Law on Refugees,
    the present Law introduces a considerable number of amendments to the Law on Refugees (Laws of 2000 to 2014-Amendment 2). Among the amendments, article 12 of the present Law supplements the basic Law by adding, after article 9 thereof, the following new articles, amongst other: 9A on the information; 9B on the issuance of travel documents; 9D on the residence and the freedom of movement; 9E on restriction to the free residence and movement; 9H on the access of minors to training and education; 9I on the access of applicants to the labour market; 9J on the vocational training.

    For the purpose of harmonizing Cypriot legislation with the Directive 2013/32/EU of the European Parliament and of the Council of 26 June 2013 on common procedures for granting and withdrawing international protection, as amended and of better implementing the basic Law, the present Law (Amendment 2) introduces a number of amendments to the Law on Refugees (Laws of 2000 to 2016) with regard to the procedure of asylum application, to the procedure of the examination thereof and to the principles governing the above mentioned procedures before the Asylum Service and the Administrative Court.

    In view of the fact (i) that the Republic of Cyprus, within which the rule of Law protects the human rights and especially the right to life and to physical integrity, opposes, as a matter of principle, to the sentence of the capital punishment, (ii) that the capital punishment has been entirely abolished within the legislation of the Republic of Cyprus and has not been implemented in practice since 1962, although article 7 para 2 of the Constitution provides for the possibility of inflicting the capital punishment by law in cases of premeditated homicide, high treason, piracy under international law and offences punished by death penalty under the military penal law, (iii) that the Republic of Cyprus is a member state to the Charter of Fundamental Rights of the European Union and that has ratified the European Convention for the Protection of the Human Rights and the Fundamental Freedoms, the 6th and 13th Protocols thereof, the International Covenant on Civil and Political Rights and the 2nd Protocol thereof, which all provide for the abolishment of the capital punishment, (iv) that it is considered necessary to adjust article 7 of the Constitution to the steadfast position of the Republic of Cyprus on the protection of human life and to subsequently amend articles 11, 47, 48, 49, 83, 106 and para 4 of article 53 of the Constitution, which are not included in the fundamental articles of the Constitution that cannot in any way be amended or repealed, the present Law introduces the 10th Amendment of the Constitution regarding the abolition of the capital punishment.
    More specifically, article 2 repeals para 2 of article 7 of the Constitution; article 3 and 4 amend the phrasing of para 3 of article 11 and para (i) of article 47 of the Constitution; article 5 repeals para (m) of article 48 of the Constitution; article 6 repeals para (m) of article 49 of the Constitution and articles 7, 8 and 9 amend the phrasing of para 4 of article 53, para 2 of article 83 and para 2 of article 106 of the Constitution, respectively.

    For reasons related (i) to the protection of private and family life of every person under article 15 of the Constitution, (ii) to the prohibition of every intervention against the exercise of such right unless it is pursuant to the law and necessary for reasons set out in the article in question, (iii) to the fact that, following the Jurisprudence of the Supreme Court, the tangible assets of every person are part of their private life and no person is allowed to impose their disclosure or audit, unless authorized by law and for purposes set out in the Constitution, (iv) to the necessity of allowing the intervention to the exercise of the right protected under article 15 for safeguarding the transparency in public life or for adopting measures against corruption in public life, (v) to the fact that the safeguarding of transparency in public life and the adoption of measures against corruption in public life constitute a necessary measure for the prevention of criminal offences, as stipulated by para 2 of article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, ratified by the Law N° 39 of 1962, the Law introduces an amendment to the article 15 of the Constitution by supplementing para 2 with the addition, after the phrase “to every person”, of the following phrase: “or to the interest of transparency in public life or for purposes of ad measures against corruption in public life”.

    Article 3 sets the date into force of the Law and stipulates the retroactive effect of paragraph (a) of article 2 of the present Law.

    For the purposes of partial harmonization of the national legislation with the European Parliament and Council Directive 2013/30/EU of 12 June 2013 on safety of offshore oil and gas operations and amending Directive 2004/35/EC, the present Law amends the Law on occupational safety and health. It specifically amends 2nd phrase of article 2A, by adding after the word "of diseases", the following phrase: "the prevention of serious accidents and the restriction of consequences of such accidents".

    The present Law amends the Laws N° 216(I) of 2012 and 52(I) of 2015 on the Retirement Benefits of Employees in the Broader Public Sector, including the Local Authorities (Provisions of General Implementation).

    Article 2 of the present Law amends article 2, by adding the following new terms and definitions: "judge" and "fix monthly amount".

    Article 3 amends article 7, by adding new reservations in subparagraph (i) of paragraph (b) of 1st phrase, concerning the calculation of the monthly gross pension emoluments; in subparagraph (ii) of paragraph (b) of 1st phrase, concerning the binding nature of the pertinent option and in 4th phrase, concerning the calculation of benefits rising from the termination of service for police members.

    Article 4 amends 2nd phrase of article 9, by replacing paragraph (a) with new one, concerning the age of the obligatory termination of service of police members and by replacing the age limit, in paragraph (b), from 60 to 58 years old, and in the 2nd reservation of paragraph (b), from 59 to 58 years old.

    Article 5 replaces article 10 with new one, concerning the voluntary early termination of service.
    Article 6 amends article 11, by amending the 1st phrase with regard to the reference to the pertinent Indexes of the Law, according to the age limit of the obligatory termination of service; by supplementing the 4th phrase, to include the employee who voluntarily relinquishes early or retires from the service, and by deleting phrases 2 and 3.

    Article 7 supplements the Law by adding new article 13A, regarding judges¿ challenge.

    Article 8 repeals Indexes 1 to 12 and introduces new Indexes 1, 2 and 3, concerning, respectively, the coefficients of conversion of one-off amounts to fix yearly amounts, the voluntary early termination of service and the coefficients of actuarial reduction in the retirement benefits of members whose termination of service takes place before the given age limit of the obligatory termination of service.

    Article 9 sets the date into force of the present Law.

    Article 2 of the present Law amends article 3, by adding new phrase 3A, which, in case of childbirth of more than one child, extends the right to maternity leave to 4 weeks for each child; and by amending respectively the 2nd reservation of phrase 5A, with an addition regarding the extension of leave from 18 weeks to additional 4 weeks for each child beyond the first from the same childbirth.

    Article 3 adds new article 11, introducing a transitional provision, which extends the scope of the present Law to female employees who, on the date of entry into force of the present Law, are on maternity leave .

    Article 2 of the present Law amends article 29, by adding within phrase 4, new paragraph (c), worded as follows: "in case of childbirth of more than one child, for a time period of 18 consecutive weeks, increased by 4 weeks for each child beyond the first from the same childbirth, starting as stipulated by paragraph (a) of the present phrase"; and by amending respectively the 2nd reservation of phrase 7, with an addition regarding an extension from a period of 18 weeks to additional 4 weeks for each child beyond the first from the same childbirth.

    Article 3 adds new article 100, introducing a transitional provision, which extends the scope of the present Law to female insured persons who, on the date of entry into force of the present Law, receive a maternity benefit, whose period of payment is increased by 4 weeks for each child beyond the first from the same childbirth.

    The present Law amends the Law on the Establishment, Activities and Supervision of Funds for Occupational Retirement Provision, for the purposes of harmonizing the national legislation:
    - with articles 1 and 4 of the European Parliament and Council Directive 2013/14/EU of 21 May 2013, amending Directive 2003/41/EC on the activities and supervision of institutions for occupational retirement provision, Directive 2009/65/EC on the coordination of laws, regulations and administrative provisions relating to undertakings for collective investment in transferable securities (UCITS) and Directive 2011/61/EU on Alternative Investment Funds Managers in respect of over-reliance on credit ratings;
    - and with article 62 and paragraphs 1, 2, 5 and 6 of article 66 of the European Parliament and Council Directive 2011/61/EU of 8 June 2011, on Alternative Investment Fund Managers and amending Directives 2003/41/EC and 2009/65/EC and Regulations (EC) N° 1060/2009 and (EU) N° 1095/2010, as amended by the aforementioned Directive 2013/14/EU;
    as well as in view of regulating the sanctions imposition in case of omission or breach of the obligation of compliance with the provisions:
    - of paragraph 1 of article 4 and subparagraph (a) of paragraph 1 of article 5 of the European Parliament and Council Regulation (EC) N° 1060/2009 of 16 September 2009, on credit rating agencies, as amended by the European Parliament and Council Directive 2014/51/EU of 16 April 2014;
    - and of the norms of the European Parliament and Council Regulation (EC) N° 648/2012 of 4 July 2012, on OTC derivatives, central counterparties and trade repositories, as amended by the European Parliament and Council Regulation (EC) N° 600/2014 of 15 May 2014.

    Article 2 of the present Law supplements 1st phrase of article 2, by adding the following new terms and definitions: "Regulation (EC) N° 648/2012", "Regulation (EC) N° 1060/2009" and "Directive 2011/61/EU".
    Article 3 supplements paragraph (b) of 1st phrase of article 3, by adding new subparagraph (iv), worded as follows: "of the Law on Alternative Investment Fund Managers, as amended or replaced".
    Article 4 supplements article 36, by adding, after 1st phrase, new phrase 1A, concerning the monitoring responsibilities of the tax collector with regard to the Funds.
    Article 5 replaces 1st phrase of article 38 with new one, regarding the appointment of investment managers in other Member States.
    Article 6 supplements article 44, by adding, after 3rd phrase, new phrase 3A, regarding the penalisation of the breach or omission of compliance with paragraph 1 of article 4 and subparagraph (a) of paragraph 1 of article 5 of the Regulation (EC) N° 1060/2009 and with the norms of the Regulation (EC) N° 648/2012.

    For the purposes of harmonizing the national legal order with paragraphs 1, 2 and 3 of article 46 of the European Parliament and Council Directive 2013/32/EU of 26 June 2013 on common procedures for granting and withdrawing international protection, and with paragraph 1 of article 26 of the European Parliament and Council Directive 2013/33/EU of 26 June 2013 laying down standards for the reception of applicants for international protection, as well as in view of the necessity for more efficient implementation of paragraph 1 of article 27 of the European Parliament and Council Regulation (EU) N° 604/2013 of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person, the present Law introduces the 8th Amendment to the Constitution of the Republic of Cyprus, regarding the institution of an Administrative Court for the benefit of the regular and orderly operation of the High Court and of the rapid course of justice.

    Article 2 amends article 146 of the Constitution, by amending the wording of paragraphs 1, 4, 5 and 6; by adding, after paragraph 1, new paragraph 1A, worded as follows: "In compliance with the provisions of the present article, a law shall define the institution, jurisdiction and competence of an Administrative Court"; by adding new sub-paragraph (d) under paragraph 4, worded as follows: "to amend entirely or partially the decision or act, as the law for an Administrative Court shall define, provided that the aforementioned [decision or act] is related to a tax issue or is a decision concerning the procedure of international protection, pursuant to the law of the European Union"; by adding, after paragraph 5, new paragraph 5A, worded as follows: "In compliance with the provisions of the present article, a court issuing a decision, according to what paragraph 5 provides for, has, as a law shall define, jurisdiction to examine and decide upon whether there has been an active compliance with its decision, and to impose sanctions against a non-compliant".

    Article 2 of the present Law amends article 2, by complementing the definition of the term "disabled persons".

    Article 3 amends the wording of 2nd and 3rd phrases of article 4 and supplements its 2nd phrase with new paragraph (g) under the 2nd phrase, worded as follows: "person who faces special personal conditions, provided that these are confirmed by a competent authority, and who does not fall within the cases of paragraphs (a) to (e)".

    Article 4 supplements article 5 by adding new sub-paragraph (vi) under paragraph (a) of 1st phrase, worded as follows: "person who is able to apply by virtue of paragraph (g) of 2nd phrase of article 4".

    Article 5 amends article 8 by adding new phrase in the reservation of the 2nd phrase worded as follows: "without taking into consideration the alimony required for persons accommodated in shelters or institutions"; by deleting the 1st reservation of paragraph (b) of 3rd phrase and by deleting the word "further" from the 2nd reservation of paragraph (b) of 3rd phrase.

    Article 6 amends article 12 by adding, under the 1st phrase, a new reservation regarding the computation of the income resulting from a pension provided by the social security fund, and by adding, under the 2nd phrase, new paragraph (h) worded as follows: "the monthly honorary allowance granted by the Ministry of Education and Culture to highly educated people and people of arts".

    Article 7 amends article 13 by adding, within paragraph (a), new phrase regarding the exclusion from computation of the immovable property, as well as new reservation regarding procedural matters; by replacing the 1st and 2nd reservation of paragraph (a) with new ones, regarding procedural matters; by supplementing paragraph (b) with new reservations regarding the exclusion from computation of any financial elements of the applicant, or of any other member of the family unit, that are not available for appropriation, as well as regarding procedural matters and by amending the wording of the 2nd and 3rd reservations of paragraph (b).

    Article 8 adds new article 13A regulating the authorization granted to the Chief of the Service for the reception of information from authorized financial institutions.

    Article 9 supplements article 14, by adding new reservation concerning the computation of any alienation of immovable or/and movable property or/and financial elements.

    Article 10 supplements article 15, by adding new reservation concerning the composition of the family unit.

    Article 11 supplements paragraph (c) of 1st phrase of article 16, by adding new reservation, regarding the conditions for increasing the monthly allowance with regard to persons with disability and the percentage of such increase depending on the degree of such disability.

    Article 12 amends the wording of phrases 2, 5 and 8 of article 32.

    Article 13 supplements article 39, by adding new phrase (6), which, starting from the date of entry into force of the Law N° 118(I) of 2015 providing for the Minimum Guaranteed Income and generally on Social Allowances (Amendment N° 2), provides for the possibility for persons receiving low pensions to apply for minimum guaranteed income, in case they did not do so according to the provisions of the article 35, for insurmountable personal reasons or for serious health reasons.

    Article 14 sets the date into force of the present Law as of 1/8/2015, except for paragraph (b) of article 5, which is in force since 11/7/2014.

    For the purposes of harmonizing the national legislation with the articles 4, paragraph 2 (a), 5 (b), 6 paragraph 3, 9 paragraph 3 (a) and (b) and 11 (I) of the European Parliament and Council Directive 2011/24/EU of 9 March 2011 on the application of patients' rights in cross-border healthcare, as well as with the article 4 of the Commission Implementing Directive 2012/52/EU of 20 December 2012 laying down measures to facilitate the recognition of medical prescriptions issued in another Member State, the present Law amends the Law N° 149(I) of 2013 on the Application of Patients' Rights in Cross-Border Healthcare (Amendment).

    Article 2 of the present Law amends article 2 by adding new term "Regulation (EC) N° 883/2004" and its definition.

    Article 3 supplements 3rd phrase of article 8, (regarding the information provision from the national contact point to patients and health professionals), by adding the following new paragraphs: (i), concerning the standards and guidelines on quality of care and patients safety provided from the Republic of Cyprus, as well as the specific healthcare providers that respect such standards and guidelines; (j), concerning the elements to be included in the prescriptions, as set out in the Annex III of the Law on Pharmacy and Poisons, as amended and replaced and (k), concerning the information framework on the cross-border healthcare provided by the national contact point, through which a clear distinction shall be made between the rights which patients have by virtue of the present Law and rights arising from Regulation (EC) N° 883/2004.

    Article 4 amends the wording of article 12 and supplements it by adding new paragraph (e) worded as follows: "upon request, the patients shall be provided from the national contact point with the relevant information on the standards and guidelines as defined by the Republic of Cyprus as Member State of treatment, as well as information on the provisions in force related to the supervision and assessment of the healthcare providers and on the specific healthcare providers that respect such standards and guidelines".

    Article 5 amends the wording of article 15 and supplements it by adding the following new paragraphs, (f) worded as follows: "in case a person insured in the Republic of Cyprus seeks cross-border healthcare, the patient's particular medical condition, the urgent nature of the incident and the individual circumstances shall be taken into consideration during the information provision or during the examination of a request subject to prior authorization", and (g) worded as follows: "in the information framework on the cross-border healthcare, a clear distinction shall be made between the rights which patients have by virtue of the present Law and rights arising from Regulation (EC) N° 883/2004".

    Article 6 supplements article 21 by adding new phrase (1A) worded as follows: "The General Director, on deciding upon the granting of prior authorization for the provision of cross-border healthcare, shall take into consideration: (i) the patient's particular medical condition, as defined in the report of the Experts Committee and (ii) the urgent nature and the individual circumstances of the patient".

    Article 7 amends article 33 by replacing 2nd phrase with new one, worded as follows: "Prescriptions that are issued in another Member State but dispensed by a registered pharmacist in the Republic of Cyprus, or issued in the Republic of Cyprus upon request of the patient to be dispensed in another Member State, shall include at least the elements set out in the Annex III of the Law on Pharmacy and Poisons, as amended or replaced. The provisions of the present phrase shall not apply with regard to the prescriptions issued in the Republic of Cyprus and dispensed in the Republic of Cyprus".

    Article 2 of the present Law amends article 2 by replacing the definition of the term "competent authority".
    Article 3 supplements the Law by adding new article 3A entitled "Exercise of power and execution of duties of public officials".
    Article 4 amends the wording of the 3rd phrase of article 32, regarding the type of appeal to be lodged before a set deadline.
    Article 5 supplements the Law by adding new article 32A on the administrative remedy before the hierarchical superior authority.
    Article 6 amends article 33 by replacing its 1st phrase with new one regarding the right to lodge an appeal before the Supreme Court.

    Article 2 of the present Law amends article 6 by adding new paragraph (e) worded as follows: "to exercise any other power, necessary for the implementation of the provisions of the present Law".
    Article 3 replaces article 12 regarding the daily and weekly rest.
    Article 4 replaces article 15 regarding the mornings and evenings off.
    Article 5 amends article 16 by adding new paragraph (g) worded as follows: "Easter Sunday".
    Article 6 amends article 17 by replacing the 2nd phrase with a new one related to the penalization and the sanction imposed to shop owners in case of non compliance with or breach of the 1st phrase of the article and by adding, after 2nd phrase, the following new phrases: 3rd phrase, regarding the conduct by Inspectors of extrajudicial settlements for offences committed by shop owners; 4th phrase, regarding the notification of the above extrajudicial settlement which defines the offence, the time of its commission, as well as the amount of the fine due; 5th phrase, regarding further sanctions in case of a second and a third consecutive offence consisting of non compliance with or breach of the 1st phrase of the article; 6th phrase, equating the above amount of fine to a penalty fee imposed due to a conviction for the relevant offence; 7th phrase, regarding the payment process and the quittance of the above amount and 8th phrase, stipulating that the extrajudicial settlement of the offence and the payment of the relevant amount does not consist of a conviction, although in case of a convicting judicial judgment for the same offence, the tribunal may take this fact into consideration for the purposes of computation of punishment.
    Article 7 replaces 2nd phrase of article 18, regarding the compensation due to every employee who consents to work during the bank holidays set out in article 16 and on Sunday as part of the weekly rest, according to article 12.
    Article 8 amends the wording of article 20.

    Article 2 of the present Law amends article 2 regarding the definition of terms. Article 3 amends article 21 by deleting the reservation included in subparagraph iii of paragraph f'.
    Article 4 amends article 26 concerning the regulations for products or/and services of special shops.
    Article 5 amends article 27 concerning the regulations for touristic shops.
    Article 6 amends article 30 by deleting the phrase "or decree" from paragraph b' of the 1st phrase.
    Article 7 sets the date of entry into force of the present Law as of 1/5/2015.
