- Adoption: 2012-12-28 | Date of entry into force: 2013-07-01 | CHN-2012-R-92672 I. Article 57 is amended to read: "To engage in the labor dispatch business, an entity shall satisfy the following conditions:
(1) Its registered capital is not less than two million yuan;
(2) It has fixed business premises and facilities suitable for businesses;
(3) It has labor dispatch management rules in compliance with the provisions of laws and administrative regulations; and
(4) It satisfies other conditions prescribed by laws and administrative regulations.
To engage in the labor dispatch business, an entity shall apply to the labor administrative department for administrative licensing in accordance with law; and after obtaining licensing, shall undergo corresponding company registration formalities in accordance with law. No entity or individual may engage in the labor dispatch business without licensing."
It also amends:
- article 63 which provides that dispatched workers shall have the right to receive the same pay with that received by other employees for the same work;
- articles 66 concerning the distinction between employment under employment contracts which is the basic means for enterprises' employing workers in China and labor dispatch, which is a supplementary form and shall exclusively apply to provisional, auxiliary or substitutive positions; and
- article 92 concerning sanctions against labour dispatchers who violate the Employment Contract Law

Adoption: 2008-01-03 | CHN-2008-M-78231 Due to the increase in the number of holidays from 10 to 11 days, the circular provides for the re-calculation of working days per year to 250, or 20.83 days per month. Provides that the 11 statutory holidays are to be included when doing a pro rata calculation of the daily or hourly wage. They are prohibited from using child labour (article 5). They are to provide for training where necessary (article 7). Also regulates the content and form of labour contracts which are to be in conformity with national and state laws (articles 8-13), as well as wages (articles 14-16), old-age, unemployment, medical, on-job injures, child-bearing and other social insurance (article 17), living allowances (article 19), vacations and labour relations.

If the dispute involves ten or more employees, it shall be considered to be a collective one (s. 4). An employee has recourse to arbitration and/or mediation (s. 5). Ch. 2 specifies the structure and composition of the bodies providing arbitration and mediation services. Ch. 3 lays down the procedures to follow in seeking a resolution to disputes; arbitral decisions may be appealed to the People's Court of Justice (s. 25). Ch. 4 addresses penalties and Ch. 5 contains supplementary provisions. Repealed in 1993.

Provisional Regulations on the implementation of the system of contracts of employment in state-run enterprises, issued by the State Council. Adoption: 1986-07-12 | CHN-1986-R-3175 The 34 sections of these Regulations set forth the manner in which the system of engaging workers under contracts of employment is to be administered. This system is to be applied without exception to workers recruited for regular jobs within the labour and wage quotas set by the Government (s. 2). Workers engaged under such contracts shall enjoy the same rights as those of permanent workers already working in the enterprise in relation to employment and other matters (s. 3). The Regulations set forth the mandatory contents of a contract of employment (s. 8) and govern its amendment, substitution, termination or cancellation (Chap. III). The grounds on which a contract of employment may be terminated by the enterprise or the worker are spelled out (ss. 12-16); the trade union is to be consulted (s. 17). Chap. IV governs benefits of workers engaged under contracts of employment and Chap. VI concerns their retirement benefits. The Regulations also contain administrative provisions (Chaps. VI and VII). Entry into force 1 Oct. 1986.

Provisional Regulations on the recruitment of workers in state-run enterprises, issued by the State Council. Adoption: 1986-07-12 | CHN-1986-R-3177 These Regulations provide that recruitment of workers by enterprises are to be done in public and open to all. Vacancy notices and lists of candidates having passed the required examination are to be published (s. 5). The basic conditions for recruitment are set forth: 16 years of age, in good health, educational level of junior middle school or above, good character, and passing a comprehensive examination (political integrity, knowledge, etc.; ss. 6-7). Women workers shall be recruited "for jobs suitable for women" (s. 8). The Regulations also describe the administrative arrangements for handling recruitment activities (Chap. III). The system of contracts of employment is to apply to recruitment (s. 3). Entry into force 1 Oct. 1986.

Provisions on the Right of Autonomy of Enterprises with Foreign Investment in the Hiring of Personnel and on Wages, Insurance and Welfare Expenses of Staff and Workers. - Adoption: 1986 | CHN-1986-M-3329 The Ministry of Labour and Personnel issued these provisions in implementation of the Provisions of the State Council regarding the Encouragement of Foreign Investment (published in Beijing Review, No. 43, 1986). The new provisions are designed to guarantee the autonomy of enterprises with foreign investment in the hiring of personnel and in the determination of wages, insurance and welfare expenses for staff and workers. Such enterprises may determine their own organisational structure and personnel system and may engage in their own recruitment, which may, with the consent of the Department of Labour and Personnel, extend to outside the locality concerned. Personnel found not to be qualified for their posts, who have become redundant as a result of production changes or who have caused harm by having violated the rules and regulations of the enterprise may be dismissed. Wages in such enterprises are to be determined by the board of directors, but shall be no less than 120 per cent of the average wages in state-owned enterprises under similar conditions in the same trade and in the same locality. Wages may be adjusted according to the economic performance of the enterprise. The enterprise shall contribute to the retirement and unemployment insurance funds and shall pay housing subsidies. Insurance and welfare available to the workers are to be determined in line with relevant provisions issued by the Government.

Adoption: 1985-12-19 | CHN-1985-R-2002 The Ordinance supplements the Employment Ordinance 1968 with a new Part VB and two schedules, providing for long service payments on separation. The amount of the payment depends on the worker's age and length of service. For example, an employee over 40 years of age who has been employed on a continuous basis for five to ten years will be entitled to compensation equivalent to two-thirds of his or her last monthly wage; such compensation will be payable only to persons who are not otherwise eligible for severance pay. The Ordinance of 1968 was published in the Legislative Series (LS 1968 - H.K. 1, 1970 - H.K. 1).
