    Amends numerous laws so as to provide more flexibility in working time and conditions, to promote continued education through paid and unpaid leave, and to allow for the temporary replacement of workers on educational leave through part-time or older workers. Provides for a possible substitution of unemployment benefit with continued education benefit, and solidarity benefits for persons whose hours of work are reduced or who are employed at a nominal level. Legislation amended includes: the Labour Contract Adaptation Act (BGBl. 459/1993), Enterprise Pension Act (282/1990), the Labour Market Service Act (315/1994), Unemployment Insurance Act (609/1977), the Lay-Off Benefit Act (47/1997), General Social Insurance Act (ASVG) (amends provsions regarding health insurance and partial pension), Social Insurance (Small-Scale Industry) Act (560/1978), Self-Employed Persons' Sickness Insurance Act (287/1971), and the Farmers' Social Insurance (559/1978).

    Amends provisions regarding arrangement of working time. Allows normal working time to be shortened or lengthened to permit more felxible free time. In shift work, the normal working time can be extended up to 12 hours, as long as an average of 40 hours a week is maintained. S. 5 provides that works agreements or enterprises not subject to a collective agreement may extend normal working time to 60 hours a week in the case of "on call" workers (Arbeitsbereitschaft). Also provides for overtime pay, maximum hours of work, rest periods for truck drivers, and the use of working time credit systems, whereby workers can save up extra hours of work.

    Prolongs opening hours of certain shops, including bakeries. Inserts a new section which allows regional governments to extend opening hours of shops until 20h if over 50 per cent of a community commutes to work and thus requires longer shopping hours. Longer business hours shall also be possible for shops which employ not more than two members of the shop owner's family.

    Provides for the right of male employees to take unpaid leave to care for their new-born babies. During the leave, the employment relationship remains intact, as paternity leave is to be considered as an extended holiday. The leave may commence at the end of the mother's prohibition to work (usually 8 weeks after birth) and is limited to the end of the child's second year of life. Paternity leave may only be taken by fathers residing in the same household as the child. Employees on such leave may not be dismissed during the period of their leave.

    Amends s. 4(5) to provide that workers in sales and commerce may, over a four-week period, work 44 hours in a particular week, as long as the normal working hours for the four-week period (as defined in s. 3) or a collective agreement are not exceeded. A collective agreement may provide for extension of the period beyond four weeks. Entry into force 1 Jan. 1988.

    This Act changes the title of the 1972 Act to the Construction Workers' Leave and Termination Act. It introduces a new Division III, entitled Conditions of Termination (ss. 13a-13h), which governs rights to severance pay in various cases. The amount of severance pay ranges from two months' wages for a worker who has completed 156 weeks of employment to twelve months' wages for a worker having worked over 1300 weeks (s. 13d). The Act also amends sections dealing with administration of the Leave and Severance Pay Fund and its financing and makes miscellaneous conforming amendments. A new subsection (3) is added to s. 2 of the Workers' Termination Act of 1979 in regard to calculating continuous service. The Insolvency (Wage Guarantee) Act is amended to provide, inter alia, that employers are to pay a supplement; when it has been paid, no claim to severance pay can be made in case of insolvency (amendment of s. 12(1)(Z) and addition of subs. Z5 to s. 1(3)). With the exceptions detailed in Part V of this Act, the amendments entered into force 1 Oct. 1987.

    Inserts a new subsection (9) in s. 11 providing that a young person being trained as a driver may spend no more than four hours per day and 20 hours per week at the wheel. Adds new subsections (5) and (6) to s. 15 calling for driving breaks every two hours and falling within working hours. New s. 26a deals with recordkeeping in relation to time spent at the wheel.

Les dérogations nouvellement introduites ou formulées englobent les travailleuses de l'industrie hôtelière, selon les termes de l'art. 189 de GewO 1973; certaines travailleuses des hôpitaux, des foyers de convalescents et des institutions d'assistance et de bien-être administrées par le gouvernement fédéral ou ceux des provinces; les enseignantes, éducatrices et conseillères dans l'exercice de certaines activités; les opératrices du téléphone de centres d'urgence, stations de taxi et opérations de vigilance; les interprètes de congrès et de réunions similaires; les guides de tourisme employées par des agences de voyage; les femmes remplissant des fonctions paroissiales ou religieuses, ou des services sociaux au sein d'une église ou d'une association religieuse légalement reconnue; les services sociaux de clubs, fondations, fonds ou partis politiques (sous certaines restrictions, dont une consultation avec le représentant de la salariée), et les travailleuses soumises à la loi (No. 280/1980) sur les droits des salariés agricoles et forestiers, ou à la loi fédérale (No. 146/1948) sur le travail des enfants et des adolescents (SL 1982 - Aut. 1 (codification)). Les modifications stipulent aussi que les femmes peuvent être employées jusqu'à minuit (au lieu de 23 heures) dans les établissements qui pratiquent un système d'équipes tournantes (art. 4(1)). Des limites de temps sont fixées à l'égard des changements qui peuvent être accordés en vertu de la loi (art. 8(2) et (3)). Les modifications prévoient des sanctions pécuniaires en cas d'infraction (art. 9(1)), et elles désignent les autorités chargées de l'exécution de la loi (art. 12(2)). Les modifications sont entrées en vigueur le 1er juin 1986.

    Employees must have a weekly rest period of thirty-six hours without interruption. During that time an employee may only be working under the circumstances provided under section 2, subsection 2 and sections 10 to 18 of this Act, where it is stipulated that only the absolutely indispensable number of employees to maintain the operation of a business can be obligated to work by their employer, with exceptions made for certain special work.
