The employment relationship is suspended during the time of military service. This special protection against dismissal ends one month after the soldier finishes his military service, so that a dismissal by the employer during that period is considered as unlawful and as a consequence void. On the other hand the employee is obligated to start work immediately at the end of his military service (within 6 days). Federal Act amending the Employment of Persons with Disabilities Act 1969. Text No. 721. Adoption: 1988-09-27 | Date of entry into force: 1989-01-01 | AUT-1988-L-7243 The amendments set forth a new definition of "disabled", eliminating the distinction between war-disabled and civilian-disabled. As amended, the Act places funding for sheltered workshops on a firmer footing and provides transport subsidies for disabled persons. Sec. 15 prescribes the duties of the Labour Offices in regard to placement of the disabled.

Adoption: 1988-03-23 | AUT-1988-L-4982 The Labour Resources Temporary Contracting Act is designed to protect workers who are engaged by one party but made available to perform work for a third party (ss. 1 to 3). Division I defines the Act's scope of application; Division II lays down general principles. The employer's responsibilities, especially regarding social security, are not affected by a contracting arrangement (s. 5). An agreement between the party engaging the worker and the contracted worker which seeks to evade legal obligations is prohibited (s. 8(2)). The contracting of workers to a firm in which there is a strike or a lock-out is also banned (s. 9). Division III of the Act lays down rules governing the protection of wages, minimum notice prior to dismissal, etc., and sets limits on the circumstances in which contracted workers may be used (not, for example, to reduce the number of regularly employed staff). The contracting of workers from abroad to Austria is permitted only when such engagement meets the criteria set forth in the Act (s. 16). The new Act contains administrative and penalty provisions as well. Conforming amendments are made to the Labour Market Promotion Act, the Works' Constitution Act and the General Social Security Act. New ss. 323a to 323d on labour contracting are added to the Ordinance governing the trades.

Temporary Work Agency Act (AÜG) (BGBl. 1988/196). (Arbeitskräfteüberlassungsgesetz) - Adoption: 1988-03-23 | AUT-1988-L-42817 Provides for protection of employees that are contracted out from one employer to another, especially with respect to employment protection standards and social insurance matters. The Act's scope of application is described in section 1 of this Act. In principle, employers who contract out employees to another employer do not need a permit if the contracting out will not last longer than 6 months. The employer who hires the employee temporarily assumes the responsibilities of the regular employer. In addition, the employee must agree to the temporary employment transfer and the the temporary employment must not entail disadvantages regarding working conditions and payment. The employee's regular position shall not be put at risk during the temporary contract. S. 9 prohibits the contracting out of employees to enterprises which are on strike. Consolidated text.

Employment of Persons with Disabilities Act (BEinstG) (BGBl. No. 22/1970). (Behinderteneinstellungsgesetz) - Adoption: 1969-12-11 | AUT-1969-L-42258 Obligates employers employing more than 25 employees in their business to hire disabled persons (1 disabled person per 25 employees). The scope of application covers, according to the definition under section 2 of this Act, those persons who suffer a disability degree of 50 per cent. Employers also must take into consideration the specific requirements with respect to a disabled employee's workplace and other working conditions, so that it takes appropriate action to promote disabled employees. There is also a special kind of protection against dismissals. If there is no particular period of notice, the usual period is 4 weeks, but before every dismissal the employer must consult the works committee, the committee of disabled persons and the department of the Land dealing with disabled persons where the enterprise takes its seat. Otherwise the dismissal is void. On the other hand, employment contracts during a probationary period can be terminated by both employer and employee without notice. Consolidated text.

Adoption: 1969-06-16 | AUT-1969-R-42261 Sets out the categories of persons who usually have great difficulties in obtaining an employment contract, so that the employment service must respect this group in a special way and must take appropriate action to arrange an employment contract for them.
