Están comprendidos en este decreto los trabajadores de las empresas estatales y mixtas y organismos que están en la situación descripta más arriba. Se considera despido colectivo el que afecta a un mínimo de cinco trabajadores en un plazo de tres meses.

    The object of this Regulation is to remake, without substantial alteration, the Employment Protection Regulation 1995. That Regulation will be repealed on 1 September 2001 under section 10 (2) of the Subordinate Legislation Act 1989.

    Part 1 of this Regulation contains formal provisions.

    Part 2 of this Regulation prescribes the classes of cases in which sections 7 and 8 of the Employment Protection Act 1982 do not apply. (Those sections require an employer to notify the Industrial Registrar of the employer's intention to terminate the employment of an employee and of the reasons for the termination.) The classes of cases include those of the following:
    (a) employees who have been employed by the employer for less than 12 months,
    (b) employees who are not covered by an award or agreement,
    (c) employees who are paid severance pay at the rate set out in Schedule 1 to the Regulation.

    Part 3 of this Regulation deals with notices required to be given under the Act. That Part, with Schedule 2 to the Regulation, prescribes the form that those notices are to take. The Part also contains provisions relating to the number of copies of certain notices that are required and the provision of further particulars in connection with the notices.

    Part 4 of this Regulation contains the following miscellaneous provisions:
    (a) a provision that, with Schedule 2, prescribes the form of a request for the exercise of certain jurisdiction under the Act,
    (b) a savings provision relating to the Regulation that this Regulation replaces.

    This Regulation is made under the Employment Protection Act 1982 and, in particular, under section 24 (the general regulation-making power) and the sections referred to in the Regulation.

    Main objectives of the amendment:
    - Implementation of the pay agreement (of 30 November 2016) with the trade unions of public services on the salary scheme for 2017.
    - Creation of the possibility of audiovisual interrogation for all - not only minor - witnesses in disciplinary proceedings.
    - Implementation of the EU Directive 2014/54/EU on measures to facilitate the exercise of the rights enjoyed by workers within the framework of freedom of movement for persons, into national law.
    - Establishment of a clear legal basis for collection of criminal record information both from legal practitioners as well as witnesses for admission to the judicial preparation service.
    - Adjustment of the provisions on compensatory leave for civil servants.
    - Combination of the application groups M BUO 1 / M ZUO 1 and M BUO 2 / M ZUO 2 into new application groups M BUO and M ZUO with effect from 1 January 2017.

    - Article 2. Amendments to the Wages Guarantee in case of Insolvency Act regarding expenditure from insolvency fund and unemployment insurance contribution.

    Amendments to:
    § 17 in order to be entitled to unemployment benefit, the registration to the regional employment agency must take place immediately after dismissal within 10 days; can be proceeded through Public Employment Service (eAMS account) within 10 days
    2) Benefits are granted: from the receipt of application via eAMS account within 10 days and in other cases from the date of claim.
    3)Specifies information needed to register as unemployed
    4)failure to comply might result with no benefits granted
    § 46 para 1 After submitting electronic claim, claimants has 10 days to submit in person handwritten signature to the regional Employment Service, in some cases personal appearance is not obligatory (illness)
    § 46 paragraph 5-7 Any changes affecting claim might be notified though phone call or electronically. Should claimants undertake lucrative activity his entitlement expires the same day.
