Los artículos 410 a 439, del Ministerio de Trabajo y Seguridad Social, derogan y modifican normas laborales. Se sustituye el artículo 289 de la ley núm. 15903 de 10 de noviembre de 1987, disponiéndose, que "las infracciones a los Convenios Internacionales de trabajo, leyes, decretos, resoluciones, laudos y convenios colectivos...se sancionarán con amonestación, multa o clausura del establecimiento...En los casos en que la sanción a imponer tenga como fundamento la infracción a las disposiciones de los Convenios Internacionales del Trabajo núms. 87 y 98 referentes a la libertad sindical, la base del cálculo se determinará de acuerdo al número total de trabajadores de la infractora". Se modifican los artículos 325, 326, 327, 329, 330 y 332 de la ley núm. 16320. Las modificaciones se refieren a política de empleo, reconversión laboral, formación profesional, etc. Por otra parte el Capítulo I crea el Régimen de reinserción laboral y empresarial de funcionarios públicos de la administración central.

Ley para las personas con discapacidad. -

Tiene por objeto desarrollar los medios y mecanismos que garanticen el desarrollo integral de las personas con discapacidad de manera plena y autónoma, de acuerdo con sus capacidades, y lograr la integración a la vida familiar y comunitaria, mediante su participación directa como ciudadanos y ciudadanos plenos de derechos y la participación solidaria de la sociedad y la familia.
El Capítulo III (artículos 26-30) del Título II se refiere al trabajo y la capacitación, en especial a políticas laborales, formación para el trabajo, empleo para personas con discapacidad, empleo con apoyo integral e inserción y reinserción laboral.
El Título III contempla en Sistema Nacional de Atención integral a las personas con discapacidad.

Ley del Régimen Prestacional de Empleo. -

Desarrolla el Régimen Prestacional de Empleo establecido en la Ley Orgánica del Sistema de Seguridad Social y tiene por objeto:
- Regular la atención integral a las personas integrantes de la fuerza de trabajo en situación de desempleo, a través de la Red de Servicios de Atención Integral a la Persona en Situación de Desempleo;
- Asegurar al trabajador dependiente y cotizante al Régimen Prestacional de Empleo una prestación dineraria en caso de pérdida involuntaria del empleo o de finalización del contrato de trabajo por tiempo determinado;
- Asegurar al trabajador por cuenta propia en forma individual o asociativa cotizante al Régimen Prestacional de Empleo una prestación dineraria en caso de pérdida de la ocupación productiva;
- Establecer la organización y funcionamiento del Instituto Nacional de Empleo;
- Favorecer la empleabilidad de la fuerza de trabajo;
- Fomentar el empleo y la ocupación productiva y promover el desarrollo local;
- Regular el desarrollo de la Red de Servicios de Atención Integral a la Persona en Situación de Desempleo;
- Articular mecanismos de inserción para facilitar el acceso a una ocupación productiva de calidad a todas las personas en situación de desempleo;
- Promover mecanismos para prevenir la pérdida de la ocupación;
- Definir mecanismos de participación de la persona en situación de desempleo.

Tiene por objeto establecer la naturaleza y el régimen jurídico, así como la organización y funcionamiento del Fondo Unico Social, el cual crea como un instituto autónomo con personalidad jurídica y patrimonio propio e independiente de la República, adscripto al Ministerio de la Secretaría de la Presidencia. El citado Fondo tiene por finalidad concentrar y coordinar eficientemente los procesos de captación, administración e inversión de recursos con la finalidad de optimizar el desarrollo y ejecución de las políticas, planes y programas destinados a favorecer y fortalecer con una respuesta oportuna y eficaz el desarrollo social, la salud integral y la educación. Asimismo, compete al Fondo impulsar la economía popular, promover la creación y el desarrollo de microempresas y cooperativas como formas de participación popular, en la actividad económica y en la capacitación laboral de jóvenes y adultos.

Regula el sistema de paro forzoso y capacitación laboral como uno de los sistemas que conforman el sistema de seguridad social, el cual tiene por objeto amparar temporalmente al afiliado que quede cesante, y garantizar los mecanismos necesarios que faciliten su reinserción en el mercado de trabajo. Desarrolla los principios, derechos y obligaciones de los trabajadores afiliados, empleadores y entes que intervienen en la dirección, regulación, financiamiento, administración, supervisión y utilización de los servicios y prestaciones dinerarias del Sistema, de conformidad con las disposiciones contenidas en la Ley Orgánica de Seguridad Social. Contempla, entre otras cuestiones, el mecanismo para acceder a las prestaciones, la prestación dineraria, la capacitación laboral, el servicio de intermediación laboral, aspectos administrativos y financieros del sistema, la suspensión y terminación de las prestaciones y el control y evasión del fraude.

Ley para la integración de personas incapacitadas

Se establece el Consejo Nacional para la integración de las personas incapacitadas. El Título III de la ley trata de la integración social de las personas incapacitadas: gozan del pleno ejercicio de sus derechos, tienen acceso a la educación, a la salud (equipos y prótesis que faciliten su integración), derecho a la asistencia y libre acceso a los servicios e instalaciones de uso público. Los artículos 23 a 25 tratan del derecho al trabajo y el artículo 25 dispone que las empresas públicas o privadas que empleen más de 50 trabajadores tienen la obligación de emplear un mínimo de dos por ciento de incapacitados, siempre que los trabajadores incapacitados reúnan las condiciones de aptitud y capacitación laboral necesarias para el ejercicio de los cargos ofertados.
