    El citado decreto aprueba la lista de trabajos que se encuentran prohibidos para los menores o que estos los pueden realizar observando determinadas condiciones. Establece que los menores de edad que asistan a cursos de formación práctica profesional podrán trabajar, siempre que el empleador solicite la autorización correspondiente a la Inspección General de Trabajo. Para ello, dicha entidad deberá constatar que en el lugar de trabajo respectivo existen las condiciones técnicas necesarias para prevenir el riesgo de accidentes de trabajo y enfermedades profesionales.

    El citado decreto determina los tipos de trabajo, actividades, ocupaciones y tareas que constituyen trabajo peligroso para las personas menores de dieciocho (18) años, en los términos del artículo 3, inciso d), del Convenio sobre la Prohibición de las Peores Formas de Trabajo Infantil y la Acción Inmediata para su Eliminación, 1999 (182) aprobado por la Ley núm. 25255. Asimismo, faculta al Ministerio de Trabajo, Empleo y Seguridad Social a examinar cada tres (3) años y, en caso necesario, revisar la lista de los tipos de trabajos determinados por el decreto, en consulta con las organizaciones de empleadores y trabajadores interesadas, conforme lo establecido por el artículo 4, inciso 3, del Convenio.

Article 3 provides some exceptions that may be made to the rule after consideration by the Ministry of Social Affairs, Labour, Vocational Training and Youth Rehabilitation.

    Establishes that children between 16 and 18 may be employed to perform night work in iron and steel factories, glass factories, paper factories, sugar factories and gold ore refineries, but only for the purpose of apprenticeship or professional training. Daily working hours of children shall not exceed eight hours. Employers who want to employ children for night work must have approval from Labour Inspector. Also provides for derogation from prohibition to employ children for night work under Article 1 of Labour Law.

    L'âge minimum est fixé à 14 ans, même dans le cas de l'apprentissage. Cependant de nombreuses exceptions sont prévues autorisant le travail d'enfants âgés de 12 à 14 ans pour des travaux dits légers. Le texte interdit également l'emploi de jeunes de moins de 18 ans à certains travaux, dans les mines et de nuit notamment.

    Fixe l'âge minimum d'emploi à 14 ans sauf pour des travaux légers énumérés (12 ans). Contient la liste des travaux auxquels les jeunes travailleurs de moins de 18 ans et de moins de 16 ans ne peuvent être employés. Prévoit que l'inspecteur du travail peut requérir l'examen de tout jeune travailleur afin de déterminer si le travail auquel il est employé n'excède pas ses forces. Fixe les charges maximum pouvant être portées, trainées ou poussées par les jeunes travailleurs, selon leur âge et leur sexe. Abroge les arrêtés nos 627/ITT-LS du 3 décembre 1953 et 1244/ITT-AFF-SOC du 5 septembre 1959.

    El acuerdo citado actualiza el Reglamento para la aplicación del artículo 13 del Código del Trabajo, prohibiendo la participación de adolescentes en los trabajos que define como peligrosos por su naturaleza o sus condiciones. Asigna al Ministerio del Trabajo y Previsión Social la actualización cada dos años del listado de los trabajos o actividades peligrosos. Establece las condiciones de celebración de un contrato de trabajo con un adolecente y las obligaciones que habrá de cumplir el empleador en tal sentido. Excluye de su ámbito de aplicación a la prestación de servicios a que se refiere el inciso 3 del artículo 8 del Código del Trabajo. Atribuye a la Dirección del Trabajo la fiscalización del cumplimiento de las normas del Reglamento.

    La resolución en cuestión señala y actualiza las actividades consideradas como peores formas de trabajo infantil y establece la clasificación de actividades peligrosas y condiciones de trabajo nocivas para la salud e integridad física o psicológica de las personas menores de 18 años. Precisa procedimental y administrativamente el derecho que les asiste a los adolecentes entre 15 y 17 años a obtener autorización para trabajar. Señala las actividades que se constituyen en conductas punibles.

Impone a las autoridades competentes el deber de identificar y sancionar a los responsables del incumplimiento de las disposiciones sobre la prohibición del trabajo infantil peligroso.

    The Decision repeals Decision No. 26/2007/QD-BLDTBXH of December 24, 2007, of the Minister of Labor, War Invalids and Social Affairs promulgating the regulation on pupils and students engaged in regular-training establishments and Decision No. 54/2008/QD-BLDTBXH dated May 19, 2008 of the Minister of Labor, War Invalids and Social Affairs promulgating the Regulation on evaluation of training results of regular students and pupils in vocational sites. It sets out the work that can be done by students in intermediate and colleges with respect to their vocational training.

    Ratifies the 2004-2010 Program on prevention of, and solution to, the situation of street children, sexually abused children and children subjected to heavy labor or working under noxious and hazardous conditions. The Overall objectives of the Program are to raise the awareness and promote actions of the entire society for the work of child protection; to prevent, gradually reduce and proceed to substantially reduce by the year 2010 the number of street children, sexually abused children and children subjected to heavy labor or working under noxious and hazardous conditions, and create conditions for those children to be protected, cared for, educated and to develop and enjoy an ever better life.
    2. Specific objectives:
    - To prevent the delinquency situation of children and support street children, with a view to reducing by 90% the number of those children by the year 2010, of whom 70% shall be rendered support to integrate themselves with their families.
    - To prevent, gradually reduce and proceed to substantially reduce by the year 2010 the number of sexually abused children.
    - To prevent and solve the situation that children have to do heavy jobs or work under noxious and hazardous conditions in order to reduce by 90% of the number of those children by the year 2010.
    - To raise the managerial capability of officials engaged in child protection work, specially those of the ministries, branches and People¿s Committees of all levels in charge of protecting and caring for children in special circumstances.

  170. Yemen - Hazardous child labour - Regulation, Decree, Ordinance

    In Section 7 of this Ministerial Order No. 11 of 2013, provides a list of more than 35 industries and occupations, including domestic work, work related to agriculture, fishing, textiles, mechanical work and construction, which are prohibited for children under 18 years.
    Moreover, section 8 prohibits carrying; pulling or pushing heavy weights.
    While section 15 prohibits night work and overtime work for children under 18 years.

  172. Zimbabwe - Hazardous child labour - Regulation, Decree, Ordinance

    Labour Relations (Employment of Children and Young Persons) Regulations, 1997 (S.I. No. 72 of 1997).

    Prohibits the employment of children (defined as under 16 years of age) and young persons (under 18) in underground mining, night work, work involving hazardous substances or specified machinery, or work which interferes with a child's education. Permits employment of children 12 years of age or more in light work, provided that the work is limited to 6 hours a day, appropriate records are maintained, and a contract is concluded between the employer and the child's legal guardian specifying wages and hours of work.
