    La resolución en cuestión fija los criterios para definir el “Trabajo Infantil Peligroso" (TIP), partiendo de la base que el niño y el adolescente se caracterizan por encontrarse en una etapa especial de la vida, en cuyo período no deberían exponerse a trabajos que puedan afectar su normal desarrollo, como son las "peores formas de trabajo infantil". Se fijan los criterios generales para la determinación de los trabajos peligrosos, considerando las formas de trabajo que los técnicos en seguridad e higiene en el trabajo han determinado como de extrema peligrosidad, debido a los factores de riesgo o procesos peligrosos a los que están expuestos los trabajadores. Enumera, sobre la base de diferentes consideraciones (rama de actividad, puesto de trabajo y tareas, agentes o riesgos, impactos en la salud, etc.) las tareas y procesos peligrosos a los que no deben estar expuestos los niños y niñas.

    El Capítulo XII se refiere al trabajo de los niños y adolescente y en su artículo 161 fija en quince años la edad mínima que se admitirá en los adolescentes que trabajen en empleos públicos o privados, en todos los sectores de la actividad económica. Dispone que no podrán trabajar más de seis horas diarias equivalentes a treinta y seis horas semanales y disfrutar de un día de descanso semanal, preferentemente en domingo (artículo 169) y prescribe que no podrán trabajar entre las veintidós y las seis horas del día siguiente (artículo 172).
    Asimismo, en el artículo 163, el Estado se compromete a proteger a los niños y adolescentes trabajadores contra toda forma de explotación económica y contra el desempeño de cualquier tipo de trabajo peligroso, nocivo para su salud o para su desarrollo físico, espiritual, moral o social.

    Dispone que todo aquel que de cualquier modo contribuyere a la prostitución, explotación o servidumbre sexual de personas menores de edad o incapaces, será castigado con pena de dos a doce años de penitenciaría (artículo 5) y que el que de cualquier modo favorezca o facilite la entrada o salida del país de personas menores de edad o incapaces, para ser prostituidas o explotadas sexualmente, será castigado con pena de dos a doce años de penitenciaría (artículo 6).

    Employers are responsible for ensuring that children under the age of 15 years that are employed in the enterprise are employed only in light work as set out in the list of light work which is permissible annexed to the Circular. They must also ensure that children have a health certificate before they begin work, that the workplace meets the occupational safety and health standards and that they implement the provisions of the Labour Code concerning children. When employing children for the first time, they must inform the Ministry of Labor, Invalids and Social Affairs of their province or city. Each year they must send a report to the Ministry concerning the employment of children along with the annual OSH report. Also sets out the responsibilities of the Ministry with respect to the employment of children.

    According to the Circular, children under the age of 13 years are able to be employed as actors or actresses and athletes. Children between the ages of 13 up to 15 years may be employed in
    - traditional jobs, arts and crafts;
    - wicker, making home appliances, fine art crafts from natural materials such as: rattan, bamboo, neohouzeaua, coconut, banana, water hyacinth;
    - Rearing silkworms; and
    - Packing coconut candy.

    - increasing the number of children participating in child forums at all levels to 20 per 100,000 by 2015 and 25 per 100,000 by 2020

    Article 2 deals with the organization of the implementation of the Program. The Ministry of Labour, War Invalids and Social Affairs is the main authority to implement the Program, in coordination with the Ministry of Justice, Ministry of Public Security, the Ministry of Planning and Investment, the Ministry of Finance, the Central Committee of the Vietnam Women's Union and other concerned agencies. Other Ministries may also play a role.

Children Relief Funds are public non-business units established at central and provincial levels and managed by the Ministry of Labor, War Invalids and Social Affairs (with regard to the National Fund for Vietnamese Children) or provincial-level Services of Labor, War Invalids and Social Affairs (with regard to provincial/ municipal Children Relief Funds) under the Government's Decree No. 186/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs, and Decree No. 13/2008/ND-CP of February 4, 2008, stipulating the organization of specialized agencies under provincial/municipal People's Committees.

    Persons entitled to supports from Children Relief Funds:
    - Children in exceptionally difficult circumstances, including orphans without anyone to rely on: abandoned children: disabled children; children victims of toxic chemicals; HIV/AIDS- infected children: children doing heavy or dangerous jobs or exposed to hazardous substances; children working far away from their families; street children; sexually abused children; juvenile drug addicts, and juvenile law offenders;
    - Children infected with serious or dangerous diseases requiring high treatment costs; injured children;
    - Children in mountainous, deep-lying or remote regions, former revolutionary bases, and natural disaster- or epidemic-hit areas:
    - Children of poor families who surmount difficulties and record good academic achievements at schools;

    Provides that the State is responsible for adopting policies to create conditions for youths, inter alia, to study and work (Art. 4.2). The State is also to manage youth employment by implementing policies, strategies and programs, through training, inspection of violations and complaints (Art. 5). Art. 7 provides for international cooperation on youth employment. Art. 10 sets out the rights and obligations of youths with respect to employment. Art. 18 sets out the responsibilities for the State, family and society with respect to youth employment. Art. 31 states that the State is to implement the UN Convention on the Rights of the Child, which is ratified by Vietnam.

    - To prevent, gradually reduce and proceed to substantially reduce by the year 2010 the number of sexually abused children.
    - To prevent and solve the situation that children have to do heavy jobs or work under noxious and hazardous conditions in order to reduce by 90% of the number of those children by the year 2010.
    - To raise the managerial capability of officials engaged in child protection work, specially those of the ministries, branches and People¿s Committees of all levels in charge of protecting and caring for children in special circumstances.
