    Los talleres protegidos de producción deberán participar regularmente en las operaciones de mercado y tener la finalidad de asegurar un empleo remunerado y la prestación de servicios de adaptación laboral y social que requieran sus trabajadores. A los efectos de la relación laboral especial, se consideran trabajadores discapacitados a las personas que teniendo reconocida una discapacidad superior al 33 por ciento, presten sus servicios dentro de la organización de los talleres protegidos reconocidos por la autoridad del trabajo. Institúyese con alcance nacional el régimen especial de jubilaciones y pensiones para los trabajadores discapacitados que presten servicios en relación de dependencia en talleres protegidos.

    Decreto núm. 2630/90, por el que se establece que los organismos de la Administración Pública Nacional y de la Municipalidad de la Ciudad de Buenos Aires deberán mantener los permisos o concesiones otorgados en función de lo previsto en el artículo 11 de la ley núm. 22431.

    El artículo 11 de la ley núm. 22431 (de 1981, por la que se establece un sistema de protección integral a los discapacitados) dispone que en todos los casos en que se conceda el uso de bienes del dominio público o privado del Estado Nacional o de la Municipalidad de Buenos Aires se deberá dar prioridad a las personas discapacitadas que estén en condiciones de desempeñarse en tales actividades. Se deberá considerar de nulidad absoluta la concesión o permiso otorgado sin respetar la prioridad en favor de las personas discapacitadas. El decreto núm. 2630/90 suspende los trámites iniciados para cancelar los permisos o concesiones otorgados que no habrían respetado la prioridad establecida en el artículo 11 de la ley núm. 22431 y crea una comisión encargada de realizar un relevamiento de la situación de los discapacitados en las entidades involucradas.

The intention is also to prohibit discrimination under existing laws and the administration of Commonwealth laws and programmes, to ensure that persons with disabilities have the same rights to equality before the law as the rest of the community, and to promote the recognition and acceptance within the community of the principle that persons with disabilities have the same fundamental rights as the rest of the community. Part 2 concerns the prohibition of disability discrimination; Part 3 provides for "action plans" to eliminate such discrimination; Part 4 deals with inquiries and civil proceedings; Part 5 specifies additional offences under the Act; and Part 6 provides for the appointment of a disability discrimination commissioner.

Accordingly, the Act replaces provisions of the Handicapped Persons Assistance Act 1974 and of Part VII of the Social Security Act 1947 with provisions that are more flexible and more responsive to the needs and aspirations of persons with disabilities (s. 3). Part II of the Act governs funding of services, including competitive employment training, placement services and supported employment services. Part III concerns the provision of rehabilitation services by the Commonwealth (s. 24 permits a training allowance to be paid in addition to a rehabilitation allowance under defined conditions).

Medical practitionners appointed or employed have their conditions of employment and remuneration set by the Public Services Board and are subject to disciplinary standards set forth in Schedule 4 appended to the present Act. Other staff employed by the Department under the Public Service Act 1974 remain subject to that Act.
