    Tiene por objeto establecer la inamovilidad laboral de los citados trabajadores entre el 1 de enero y el 31 de diciembre de 2013 a fin de proteger el derecho al trabajo como proceso fundamental que permite la promoción de la prosperidad, el bienestar del pueblo y la construcción de una sociedad justa y amante de la paz.

    Decreto núm. 1882, mediante el cual se integrará como claúsula irrenunciable en los contratos de trabajo vigentes y en los que se celebren durante la validez temporal del presente decreto, la que en él se señala.

    Se trata de la claúsula siguiente: "Hasta el día treinta de junio del año en curso, inclusive, el trabajador no podrá ser despedido sin justa causa calificada previamente por el Inspector del Trabajo de la juridsdicción, de conformidad con los procedimientos prevestos en la sección sexta (Del Fuero Sindical) del Título VII de la Ley Orgánica del Trabajo". Se exceptúa del ámbito personal de validez a los trabajadores que no gozan de estabilidad según el art. 112 de la Ley Orgánica del Trabajo. El patrono y la organización sindical que represente a la mayoría absoluta de los trabajadores o en su ausencia la coalición o grupo que ostente esta representación podrán acordar la reducción del personal durante la vigencia de este decreto.

    Resolución del Ministro del Trabajo núm. 4388 por la que se crea una Oficina en las Federaciones de Trabajadores de mayor representatividad regional, en cada uno de los Estados de la República de Venezuela, donde los Procuradores Especiales del Trabajo despacharán y oirán consultas sobre el objeto de esta resolución.

    El tercer considerando declara que el Convenio núm. 158 -ratificado por Venezuela en 1985- "establece la obligación del Estado de velar por la Estabilidad Laboral". El quinto considerando declara que "es obligación de carácter imperativo del Ministerio de Trabjao velar por la protección de los derechos laborales fundamentales de los trabajadores, apoyar el desarrollo de la negociación colectiva y estimular el crecimiento de las organizaciones sindicales como principio rector para el fortalecimiento de la Democracia. Asimismo, ser garante del sistema integral de seguridad social del país, conforme con la Constitución Nacional". Se decide la creación de oficinas de procuradores especiales del trabajo en las federaciones de trabajadores. Tales procuradores deberán "despachar y oir consultas según las facultades otorgadas en la legislación". Además, ejercerán funciones polivalentes, participando en los procedimientos conciliatorios y de arbitraje, dentro del marco de la concertación social.

    An Act to provide for the disclosure of conduct adverse to the public interest in the public and private sectors; provide for a framework within which public interest disclosures shall be independently and rigorously dealt with; provide for procedures in terms of which employees in both the private and the public sectors may disclose information regarding unlawful or irregular conduct by their employers or other employees in the employ of their employers; safeguard the rights, including employment rights, of persons who make public interest disclosures; provide a framework within which persons who make a public interest disclosure shall be protected; and for matters connected with, or incidental to, the foregoing.

    Provides for preferential payments in banksruptcy. Gives effect to ILO convention No. 173 on Protection of Workers' Claims in the event of Insolvency of the Employer. Priority debts are listed in section 2. Repeals Preferential Claims in Bankruptcy Act.

    Labour (National Employment Code of Conduct) Regulations, 2006 (S.I. No. 15 of 2006). - Regulations on-line

    Provides a code of conduct for the termination of a contract of employment for disciplinary reasons. It defines the meaning of misconduct, sets out the steps to take for termination of the contract and provides measures for disciplinary procedures. It also includes regulations for penalties and appeals. The Labour Relations (General Conditions of Employment) (Termination of Employment) Regulations, 2003 (S.I. No. 130 of 2003) are repealed.

    Labour Relations (Retrenchment) Regulations, 2003 (S.I. 186 of 2003).

    Regulates the retrenchment of less than 5 employees in any six month period including the giving of notice, the establishemnt of a Retrenchment Board and approval of retrenchment. These Regulations repeal the Labour Relations (Retrenchment) Regulations, 2003 (S.I. 132 of 2003). Retrenchments of 5 employees and over are dealt with under sections 12C and D of the Labour Act.

    Labour Relations (Terminal Benefits and Entitlements of Agricultural Employees Affected by Compulsory Acquisition) Regulations, 2002 (S.I. No. 6 of 2002).

    Determines amount to be paid by employer to employee in the event that it became necessary for the employer to terminate the employment of employee because farm or part of farm belonging to the employer has been compulsorily acquired for resettlement or other purposes in terms of the Land Acquisition Act. Also determines when employment is deemed to have been terminated because of compulsory acquisition. Establishes Agricultural Employees' Compensation Committee. Determines when terminal benefits and entitlements due may be deducted from compensation payable to employer.

    Labour Relations (Dairy Trade Industry) (Employment) (Amendment) Regulations, 1993 (No. 2) (S.I. No. 275 of 1993)

    Provides than an employer may not summarily or otherwise terminate a contract of employment with an employee unless he has obtained prior written approval of the Minister to do so. Also provisions in respect to minimum wages, transfer allowances and benefits after death of employee.
