    Ley núm. 21015, de 29 de mayo de 2017, que incentiva la inclusión de personas con discapacidad al mundo laboral - Biblioteca del Congreso Nacional de Chile

    La ley citada incentiva la inclusión de personas con discapacidad al mundo laboral. A tal fin, modifica el artículo 45 de la ley núm. 20422, que establece normas sobre igualdad de oportunidades e inclusión social de personas con discapacidad, a efectos de promover la selección preferente, en igualdad de condiciones de mérito, de personas con discapacidad para ocupar cargos en los órganos del Estado que señala. Asimismo, sustituye el inciso tercero del artículo 17 de la ley núm. 18834, sobre Estatuto Administrativo, prohibiendo todo acto de discriminación arbitraria que se traduzca en exclusiones o restricciones que tengan por objeto anular o alterar la igualdad de oportunidades o trato en el empleo. Además, modifica el Código del Trabajo, imponiendo a las empresas de 100 o más trabajadores el deber de contratar o mantener contratados, según corresponda, al menos el 1% de personas con discapacidad, y señalando las medidas que deberán ejecutar las empresas que, por razones fundadas, no puedan cumplir total o parcialmente dicha obligación.

    The present Law regulates issues regarding the Candidates Evaluation for Recruitment in the Public Service (Temporary Provisions), in view of:
    - the suspension of filling of first recruitment vacancies, of first recruitment and promotion vacancies and of promotion vacancies for 2016 (01.01.2016-31.12.2016), pursuant to the article 17 of the Law of 2015 on the Budget of 2016;
    - the fact that similar regulations may be included in the State Budget of 2017 (01.01.2017-31.12.2017) because of the need for confining the public expenditure;
    - the fact that the aforementioned article provides for the possibility to exempt from the suspension of filling of vacancies those that are necessary to be filled following the proposal of the competent authority;
    - the fact that it is considered necessary to regulate on a temporary basis the process of filling of vacancies in the Public Service, for which vacancies the provisions of the Law on Public Service apply and which fall within the scope of application of the Law on the Candidate's Evaluation for Recruitment in the Public Service, in case those vacancies are to be exempted from the suspension of filling.

    Article 2 provides for the definition of the following terms: “written examination”, “position”, “Law” and “Examinations Service”.

    Article 3 introduces special provisions for the suspension of application of several provisions of the Law and for the temporary insertion of other provisions for the filling of vacancies that are to be exempted from the suspension of filling.
