La Charte nationale. - Adoption: 1986-02-09 | DZA-1986-M-2043 La nouvelle Charte nationale, promulguée le 16 février 1986, possède un caractère constitutionnel. Elle fait suite à plusieurs textes fondamentaux adoptés depuis le début de la révolution algérienne, notamment à la première Charte de 1976, qu'elle vise à compléter et à enrichir. A l'instar de la précédente, la Charte de 1986 est conçue comme une déclaration de principes générale, plutôt que comme un texte établissant des droits et obligations détaillés. De longs développements sont consacrés, en Avant-propos, aux fondements historiques de la société algérienne, puis aux références idéologiques que sont l'Islam et le socialisme (Titre 1er). Les institutions nationales, soit le parti, l'Etat, et les mécanismes de contrôle font l'objet du Titre 2e, tandis que le 3e Titre traite du développement global (organisation de l'économie, développement rural, industriel, culturel et social, aménagement du territoire). Au sein de cette dernière partie, les principes de base relatifs au travail, à l'emploi et aux salaires, à la protection sociale et à la formation sont définis. Aux termes de la Charte, le travail est non seulement un droit, mais aussi un devoir; le parasitisme et l'oisiveté doivent être radicalement abolis. La politique salariale repose sur la notion d'un salaire minimum garanti; une harmonisation des salaires sera mise en oeuvre par le biais d'une classification à l'échelle nationale. La Charte se prononce en faveur du travail des femmes, qui doit s'accompagner de règles strictes destinées à assurer la protection de la maternité et à garantir la cohésion de la famille. Elle prévoit également l'encouragement aux petites et moyennes entreprises, publiques et privées. La Charte de 1986 a été adoptée par referendum (10.508.863 voix pour, 181.063 contre) le 16 janv. 1986.

Adoption: 1994-09-13 | ARG-1994-C-39832 En la sección I, el art. 39 estipula: El trabajo es un derecho y un deber social. 1.- En especial se establece: derecho al trabajo, a una retribución justa, a condiciones dignas de trabajo, al bienestar, a la jornada limitada, al descanso semanal, a igual remuneración por igual tarea y al salario mínimo, vital y móvil...2.-La Provincia reconoce los derechos de asociación y libertad sindical, los convenios colectivos, el derecho de huelga y las garantías al fuero sindical de los representantes gremiales.- 3.-En materia laboral y de seguridad social regirán los principios de irrenunciabilidad, justicia social, gratuidad de las actuaciones en beneficio del trabajador, primacía de la realidad, indemnidad, progresividad y, en caso de duda, interpretación a favor del trabajador. 4.-...la Provincia garantiza a los trabajadores estatales el derecho de negociación de sus condiciones de trabajo y la sustanciación de los conflictos colectivos entre el estado provincial y aquellos a través de un organismo imparcial que determine la ley". El art. 36 estipula que la Provincia promoverá la eliminación de los obstáculos económicos, sociales o de cualquier otra naturaleza que afecten o impidan el ejercicio de los derechos y garantías constitucionales y a tales fines reconoce los derechos sociales de, entre otros, la niñez, discapacitados, mujer, a la vivienda, salud, de los indígenas, etc.

Entre las atribuciones del Congreso, se menciona la de "reconocer la preexistencia étnica y cultural de los pueblos indígenas argentinos", "proveer lo conducente al desarrollo humano, al progreso económico con justicia social, a la productividad de la economía nacional, a la generación de empleo, a la formación profesional de los trabajadores..." El Congreso debe además "legislar y promover medidas de acción positiva que garanticen la igualdad real de oportunidades y de trato y el pleno goce y ejercicio de los derechos reconocidos por esta Constitución y por los tratados internacionales sobre derechos humanos, en particular respecto de los niños, las mujeres, los ancianos y las personas con discapacidad". Se deberá también dictar "un régimen de seguridad social especial e integral en protección del niño en situación de desamparo, desde el embarazo hasta la finalización del período de enseñanza elemental, y de la madre durante el embarazo y el tiempo de lactancia". Se agregan disposiciones sobre la Auditoria General de la Nación y el Defensor del Pueblo. Se establece la posiblidad de reelección del Jefe del Estado, y se crea la figura de Jefe de Gabinete.
