    Esta ley orgánica, cuyos objetivos consisten en garantizar a los trabajadores, permanentes y ocasionales, condiciones de seguridad, salud y bienestar en un medio ambiente de trabajo adecuado y propicio para el ejercicio de sus facultades físicas y mentales, objetivos que son de la responsabilidad de los empleadores, subsidiarios o agentes, es aplicable a los trabajos efectuados por cuenta de un empleador en empresas y en general en todos los establecimientos industriales o agropecuarios, comerciales, de servicios, y cualesquiera sea la naturaleza de sus actividades, el lugar donde se ejecuten, persigan o no fines de lucro, sean públicas o privadas. Consta de doce capítulos, que versan, en particular, sobre el Consejo Nacional de Prevención, Salud y Seguridad Laborales (cap. III) creado por la ley, las obligaciones de los empleadores y de los trabajadores (cap. VI), la higiene y seguridad laborales (cap. VII), las enfermedades y accidentes profesionales (cap. VIII) y las sanciones (cap. IX).

    Se reafirma la organización federal del Estado. Los Municipios constituyen la unidad política primaria y autónoma dentro de la organización nacional. El Capítulo III del Título III enuncia los derechos individuales y el Capítulo IV del mismo título los derechos sociales. El art. 76 establece que todos tienen derecho a la protección de la salud, el art. 77 que el Estado propenderá a mejorar las condiciones de vida de la población campesina, el art. 78 consagra el derecho a la educación y los artículos 84 a 94 enuncian normas de protección al trabajador: Todos tienen derecho al trabajo, el trabajo será objeto de protección especial, todos los trabajadores disfrutarán de descanso semanal remunerado y de vacaciones pagas en conformidad con la ley, la ley garantizará igual salario para igual trabajo, sin discriminación alguna, fijará la participación que debe corresponder a los trabajadores en los beneficios de la empresa, etc. Se consagra el derecho de huelga, la protección especial a la mujer y al menor trabajadores, etc. La ley favorecerá el desarrollo de las relaciones colectivas de trabajo y establecerá el ordenamiento adecuado para las negociaciones colectivas; los sindicatos de trabajadores y los de patronos no estarán sometidos a otros requisitos para su existencia y funcionamiento que los que establezca la ley con el objeto de asegurar la mejor realización de sus funciones propias y garantizar los derechos de sus miembros.

    The 2019 Labor Code revokes the 2012 Labor Code. The 2019 Labor Code expands the scope of application to "workers without labour relations" defined as workers who work without an employment contract. It also broadens the definition of Employee to "a person who works for an employee under an agreement, is paid, managed and supervised by the employer."
    The Code also modifies the type and content of labour contracts and provides more bases for both employers and employees to unilaterally terminate labour contracts. The main changes are the following:
    - WAGES, HOLIDAYS & HOURS OF WORK: The monthly overtime cap is increased from 30 to 40 hours. There is to be an additional national holiday implemented. Concerning wages, employers are still required to set up salary schemes and consult with employee representative organisations. However, the schemes no longer require registration and notification with the labour authorities.
    - TERMINATION OF EMPLOYMENT: The Code recognises sexual harassment at the workplace as an additional ground for dismissal.
    - MIGRANT WORKERS: For foreign workers, the new Labour Code limits the term of work permits to a maximum of two years, which may be extended for a further two years. However, after this, migrant workers will need to apply for a new work permit.
    - RETIREMENT: Retirement age is to be increased to 60 years for female workers and 62 for males. Exemptions apply for workers working in hazardous conditions.
    - FREEDOM OF ASSOCIATION: The Code recognises the right of employees to set up their own representative organisations.
