Résumé/Citation: Amends a number of sections of the Workplace Relations Act 1996 as well as consequential amendments to a number of other Acts. In particular, amends section 326 with respect to Individual transitional employment agreements (ITEA). Replaces Division 5A which regulated the Fairness Test with a new tougher "no-disadvantage test". Started a process of "award modernisation" by introducing the ITEAs (individual employment agreements made between an employer and an employee where the employee would otherwise be covered by an award or enterprise collective agreement) to replace the Australian Workplace Agreement (AWA).
