Resumen/cita: Requires employers with 100 or more workers, excluding part-time employees, to give 60 days' advance notice of shutdowns of operations which affect at least 50 workers (sections 2 and 3). It also requires employers to give the same amount of notice of layoffs that would last more than six months and affect at least one-third of the workers at the employment site (ibid.). The notice period may be reduced under certain circumstances. Various exemptions are available, in particular if the closing resulted from a strike or lockout, of if the employer has sold its the business to a successor who agrees to continue employing the workers involved. Remedies in case of violation include an employee's back pay and benefits which may be awarded by a federal court, as well as a fine which may be imposed for failure to give advance notice to local governmental authorities. The remedies provided are to be exclusive for any violation of this Act (section 5(b)). Certain aspects of the notice provisions under this Act as they relate to provisions of the National Labor Relations Act and the Railway Labor Act are addressed in sections 4 and 9.
