Abstract/Citation: The Act prohibits manual scavenging and the manual cleaning of sewers and septic tanks without protective equipment as well as the the construction of insanitary latrines. Any one who violates the provisions of the Act by employing manual scavengers or failing to demolish insanitary latrines is liable to imprisonment of 1-2 years, and fine of Rs 50,000 - Rs 1 lakh. Anyone who employs a persons for hazardous cleaning of septic tanks and sewers is liable to imprisonment of 2-5 years and/or fine of Rs 2- 5 lakh.
The Act also provides for the rehabilitation of persons identified as manual scavengers, and their families, including the provision of scholarships to children, housing, training and financial assistance.
The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 or in any other law, or in any instrument having effect by virtue of any other law.
