| Abstract/Citation: | Act No. 435/2004 has been amended to take into account the new territorial structure of Labour Offices as well as to the existence of new labour agencies. The following sections are modified: Section 4 concerning the prohibition of discrimination in realization of the right to employment. Sections 5, 6, 8a (concerning a dismissal for serious professional fault), 9, 12, 14, 20, 24, 25, 29, 30, 33, 35. Repeals section 36, amends sections 37b, 38, 39, 41, 48, 53, 58a, 59, 60, 61, 65, 66, 67, 72, 75, 76, 77, 78, 80, 81, 82, 86, 87, 90, 92, 95, 102, 105, 109. Adds a new Section 109a about self-provided retraining of job-seeker and the subsidies given for this purpose by the Labour Office. Amends sections 111, 112, 113, 118, 119. Includes a new Chapter 5 containing a new Section 119a on shared providing of employment. This regulates relationships of district branches of the Labour Office with employment agencies eventually contracted to share burden of placement into employment. The act further amends sections 182, 126, 127, 130, 132, 139, 140, 141, 145, 147, 147a. Adds Section 147d about safeguard of data related to employment placement. This Act also amends the following Acts to update sections where Act 435/2004 was referred to: - repeals Section 8(1)c of the consolidated Act No. 582/1991 on organization of social security; - amends section 2 of the consolidated Act No. 118/2000 on protection of employees in case of insolvency of employer; - amends section 8(2) of the consolidated Act No. 634/2004 on administrative fees; - amends sections 3, 12 and 26 of the consolidated Act No. 251/2005 on Labour inspection; - amends section 101(2) of the Act No. 137/2006 on public procurement; - amends sections 48 and 103 of the consolidated Act No. 262/2006 Labour Code. |
